The Constitutional endorses the tax regime of film productions in the Canary Islands

The Plenary of the Constitutional Court (TC) has endorsed the tax regime for film productions in the Canary Islands by unanimously dismissing the appeal filed by the Canarian Parliament against one of the final provisions of the decree-law that regulates it.

As reported by the guarantee court, the Plenary has validated the third final provision of Royal Decree-Law 12/2021, which modified the Economic and Fiscal Regime of the Canary Islands, by updating the absolute limit of the deduction for investments and expenses in film productions Spanish and foreign companies from 5.4 to 12.4 million euros, in corporation tax.

The sentence, for which Judge César Tolosa has been the rapporteur, considers that the procedural guarantee provided for in the Canary Islands Statute of Autonomy has been respected, consisting of requiring a prior report from the Parliament of the Canary Islands to proceed with the modification of the economic and archipelago prosecutor In this sense, it indicates that said report was requested from the legislative body prior to the process of validation of the decree-law.

Likewise, the ruling rejects that the essential content of this economic regime has been violated, stating that the preservation of a "differentiated fiscal policy" does not include the existence of a minimum unavailable nucleus.

In addition, in this case the TC considers that the circumstances justifying the urgent legislation concur, without the principle of legal certainty being violated as the norm is clear and predictable in its effects.
