The General Council of the Judiciary (CGPJ) has agreed to extend the specialization plan on unfair terms in 16 judicial bodies of nine autonomous communities for between six months and one year, which was scheduled to expire on December 31.

As reported by the governing body of the judges, the Permanent Commission has concluded the measure in six other courts due to the significant decrease in pending matters and the normalization in the entry of new demands.

Through a press release, collected by Europa Press, the CGPJ has explained that, with the favorable report from the Ministry of Justice and the Autonomous Communities with jurisdiction over the Administration of Justice, and after having consulted the Government Chambers of the Superior Courts of Justice, it has been agreed to maintain specialization throughout 2023, on an exclusive and exclusive basis, in 8 judicial bodies in Cádiz, Málaga, Seville, Valladolid, Madrid, Alicante, Valencia and Bilbao.

Likewise, it has agreed to extend the specialization for another six months --between January 1 and June 30, 2023-- in eight other judicial bodies in Ciudad Real, Toledo, Murcia, Castellón, San Cristóbal de la Laguna, Vitoria, San Sebastián and Barcelona, ​​but the latter in a non-exclusive way.

Finally, it has decided to end the measure in the 6 remaining courts, in León, Santander, Oviedo, Burgos, Pamplona and Palma de Mallorca.

In this context, the CGPJ has recalled that the specialization plan on unfair terms was launched on June 1, 2017 and, from that date until today, it has been continuously extended, in the manner and for the estimated time necessary for each judicial body.

Last June, in the last agreement on this matter, the Permanent Commission concluded the plan in 2 courts and extended it in another 22 until December 31, 2022.

"The evolution experienced can be described as positive, both with respect to the pendency and the rate of resolution of matters, which has allowed the plan to be progressively annulled and in accordance with the situation of each judicial body throughout the years. these five years. In general, the indicators have improved as the specialization plan and reinforcements, both personal and material resources, have been consolidated", has assessed the CGPJ.

The plan consists, explained the Permanent Commission, in the specialization of certain courts of first instance and first instance and instruction for the attribution, in the territorial scope established in each case, of the knowledge of matters related to individual actions on general conditions included in financing contracts with real estate guarantees whose borrower is a natural person (unfair terms).

"The exclusive attribution of competence in this matter has also allowed the standardization of criteria, thus reinforcing the principle of legal certainty," the statement concluded.
