For the first time in Guipúzcoa, a sentence of 6 to 4 years is reduced by the Law of "Only yes is yes"

The Third Section of the Provincial Court of Gipuzkoa has reduced, for the first time in Gipuzkoa territory, a sentence from six to four years in prison for a young man for sexual assault on a minor at parties in the Gipuzkoan town of Zarautz in 2017, in application of the new Law of 'Only yes is yes'.

The Chamber has reviewed the sentence to lower the custodial sentence through an order against which an appeal can be filed. The events occurred on June 22, 2017 at dawn in an abandoned house in Zarautz to which the convicted person, who was then 18 years old, and his victim, who was 16, went after having met in bars at the Sanpelayos festivities.

The Prosecutor's Office and the private prosecution, exercised by the victim's family, requested nine years in prison for the young man sentenced to six, the minimum sentence to be imposed for the crime of sexual assault according to the previous Penal Code, and that this sentence is now reduced to four years as this fork has been modified from four to 12 years.
