The Association of Prosecutors (AF), the majority in the prosecutorial career, has requested this Wednesday the resignation of the State Attorney General, Álvaro García Ortiz, alluding to the "crude maneuver" to award his predecessor in office, Dolores Delgado, the position of prosecutor of the Democratic Memory and Human Rights room and for giving "manipulated information" in "discredit" of the also former attorney general of the State Consuelo Madrigal.

In a statement, collected by Europa Press, the AF denounces that "the deterioration of the institutional image of the Public Prosecutor's Office has reached one of its highest limits, if it were still possible."

He alludes to García Ortiz's decision to advance the Fiscal Council from June 19 to 8, in which nine positions will be awarded, including the one Delgado aspires to, as well as his refusal to suspend it, as AF and APIF had requested, before the possibility that after July 23 there will be a new government and attorney general.

"No State Attorney General (FGE) had anticipated, with a crude maneuver, a Fiscal Council already convened only to make some appointments," the AF asserted.

He has also criticized that García Ortiz cited Madrigal as a precedent. Through two internal bulletins, the Infofiscalía, he assured that he made up to twelve discretionary appointments already in an electoral climate.

The AF --to which Madrigal belongs-- claims that it, "during its tenure as FGE, did not hold any Fiscal Council to make appointments once general elections were formally called."

In this sense, he criticizes that García Ortiz "has equated the announcement of general elections with the official announcement of the electoral process to try to justify situations that are not comparable."

It also points out that "it is public and notorious that positions as relevant as those of the prosecutor of the Anti-Corruption Chamber, the National Court and the Support Unit were summoned at the proposal of the next FGE, José Manuel Maza."

Likewise, the AF reproaches García Ortiz "for using the means of communication of the State Attorney General's Office (Infofiscalía) to answer a particular question, in a kind of personal reckoning, lacking the minimum rigor of who is supposed to He is a renowned jurist."

In his opinion, "after this action, it becomes clear the need to interest the resignation of the FGE for providing intentionally manipulated information, using for this purpose the institutional channels in alleged discredit of Consuelo Madrigal."

THE APIF ACCUSES THE FGE OF "CHEATING"

Along the same lines, the Professional and Independent Association of Prosecutors (APIF) has issued a statement in which it accuses the attorney general of trying to "deceive citizens and prosecutors."

In line, he specifies that "Madrigal did not make an appointment proposal with the dissolved chambers." He reports that on September 29, 2015, a contest for discretionary positions was published in the BOE, on October 1, the then Prime Minister, Mariano Rajoy, announced in an interview that there would be general elections on December 20 and In October the Fiscal Council was held where a series of appointments were proposed. It was not until October 27 when the Cortes Generales were dissolved, he emphasizes.

On May 30, the dissolution of Parliament was published in the BOE, "then the current attorney general will hold a Fiscal Council on discretionary positions with the Cortes dissolved, and Madrigal did not do so," he claims.

It also highlights that "Madrigal left up to 30 appointments pending, for the next attorney general (who was Manuel Maza) to make, three of them courtroom prosecutors, while it makes it ugly that García Ortiz "will leave what remains vacant of the appointments that I propose now".

For the APIF, "Madrigal did not deceive, while the General Prosecutor's Office has taken advantage of an internal communication instrument of the Prosecutor's Office to spread manipulated information." "We wonder what we have done to deserve this," she concludes.
