The Professional and Independent Association of Prosecutors (APIF) has announced this Friday that it will transfer to the European Commission the election of Dolores Delgado for the position of prosecutor of the Democratic Memory and Human Rights Chamber, considering that it is an "unprecedented scandal" that may affect the rule of law in Spain.

In a statement collected by Europa Press, the association calls for the resignation of the State Attorney General, Álvaro García Ortiz, whom it accuses of having "avoided" delaying the appointment of Delgado so that the Fiscal Council could not analyze "a possible incompatibility of the chosen".

APIF points out that analyzing this possible incompatibility is "the competence of the Fiscal Council, not the attorney general." "Since he does not like that something that he does not control can be voted on, he does not let them vote," he censures.

He regrets the way in which García Ortiz has appointed his predecessor in office and former Minister of Justice, pointing out that "it is not just that there has been an effective exchange of appointments between the two: the former attorney general promotes the current attorney general, who, in turn, when the time comes, she promotes the former attorney general."

"There are no rules to prevent the authoritarian will of those who call themselves progressive from being imposed," says the association, which advocates the resignation of García Ortiz, like the majority Association of Prosecutors (AF).

He considers that it is an "unprecedented scandal". "And that in the Prosecutor's Office is saying a lot. The State Attorney General, capable of perpetrating this type of action, should resign," he maintains, while advancing that he will transfer this case to the European Commission for its analysis on the Rule of Law in Spain.

This Thursday, the State Attorney General proposed his immediate predecessor in the position for the position of prosecutor of the Democratic Memory and Human Rights room, despite the rejection of the majority of the Fiscal Council, in a plenary session developed between "quite a lot of tension" , according to sources consulted by Europa Press.

The members of AF and APIF asked García Ortiz to suspend the plenary session given the possibility that after the general elections on July 23 there will be a new government and a new attorney general. Failing to agree to this, APIF proposed as an alternative that the FGE refrain from making said appointment, given its "personal and professional relationships" with Delgado.
