The Court of Álava reduces two sentences for sexual assault by a year and a half by applying the 'law of only yes is yes'

The Second Section of the Provincial Court of Álava has reduced from four years to two years and seven months in prison the sentence imposed on two people convicted of separate crimes of sexual assault, a modification that is carried out in application of what is known as the 'law of only yes is yes'.

The reduction of both sentences is included in two orders of the Provincial Court of Álava, dated January 12 and 18, which accept the revision of the sentence requested by the defenses of the two defendants.

In both cases, the defendants were sentenced to four years in prison and ten years of restraint and prohibited from maintaining any type of communication with their victims, being considered responsible for two crimes of sexual assault. In both sentences, the highly qualified mitigation of damage reparation was applied.

The court accepts the request of the defenses, estimating that the sentence initially imposed "exceeds the legal framework that is currently applicable" for this type of crime, taking into account the mitigation applied.

The records in which this sentence reduction is reflected, collected by Europa Press and which can be appealed, do not modify the prohibition of approaching and maintaining communications with the victims -set at ten years-, since this issue was not subject to legal modification since the sentence was handed down.
