The president of the Superior Court of Justice of Asturias (TSJA), Jesús María Chamorro, has defended this Tuesday in Gijón, regarding the law of 'only yes is yes', that judges act "independently" and apply the norm that the legislator approves.

This has been indicated, in statements to the media, before visiting the new Court for Violence against Women in Gijón, located in the Palace of Justice.

Chamorro has specified that the decision to modify or not a law corresponds to the Legislative power. Therefore, he has indicated that, as president of the TSJA, he has no opinion on the matter.

He has also stressed that judges apply the rules, but not in isolation, since they are part of a legal system, which "technically is very complex," he remarked. Yes, he has regretted that sometimes opinions are given on this issue without having "sufficient knowledge, from a legal technical point of view."

He has also pointed out that he does not believe that in Asturias there is a disparity of criteria in the application of the 'only yes is yes' law. Related to this, he explained that up to now there have been eight proceedings in which sentences have been reviewed based on this law, to which he has given the example of a sentence in which the sentence was reduced from one year to one condemned.
