One year in prison in Soria for the author of the slap on TikTok for assault "before thousands of people"

The Criminal Court of Soria has sentenced the man who slapped his wife in the face to one year in prison while she was doing a live broadcast on the TikTok social network. He is sentenced as the author of a crime of mistreatment in the field of violence against women for aggression "before thousands of people."

The sentence includes a three-year ban on coming within 300 meters of the person, home and workplace of the victim and on communicating with her by any means or procedure, direct or indirect.

Likewise, he is sentenced to another three years of deprivation of the right to possess and carry weapons, according to the sentence issued this Monday by the Superior Court of Justice of Castilla y León and collected by Europa Press.

The judge has estimated, once the evidence as a whole has been assessed, that "the defendant, in a public and notorious manner, in front of thousands of people, assaulted his wife, with the intention of undermining her physical integrity and humiliating her in public."

Likewise, it has added that "without the record that it caused injuries, there was obvious and real mistreatment, with which all the requirements set forth in article 153.1 of the Penal Code are met and the defendant is sentenced as the author of a crime mistreatment in the field of violence against women".

In the sentence, the magistrate has clarified that "in crimes of gender violence, the victim's complaint is not necessary, and punishment must be given once its commission is known."

In this sense, he has pointed out that "the simple fact of the live broadcast of the slap is enough for the public powers to deploy the scope of protection of the victim, regardless of whether she recognizes herself as such."

The judge has indicated that "it is not justification of the aggression, nor does it suppose that it is not punished, the fact that the victim consents and justifies the slap."

"In crimes of violence against women, as in all crimes of serious injuries, the consent of the person attacked is irrelevant and the punishment proceeds in all cases," warns the judge.

In grading the sentence, the judge has taken into consideration that the man "beat the victim in public, in front of thousands of people, with the purpose, in addition to causing physical abuse, to humiliate and belittle her before her friends and acquaintances; imposed his domination over his wife on social networks, without the fact that he was live making him stop his aggression; and he felt offended by what they had said to his wife and reacted by attacking her in public".

"This conduct deserves the greatest criminal reproach that the law allows, it deserves the maximum penalty to be imposed, since the defendant is not capable of respecting his wife, not even in public," the ruling states.

In addition, "this behavior has already been repeated on previous occasions, since the victim acknowledges that, prior to these events, he has received two beatings."
