The Association Judges and Judges for Democracy (JJpD) has criticized this Monday the "unacceptable" and "intolerable" situation of the General Council of the Judiciary (CGPJ), which has completed four years in office, while asking "whom has repeatedly rejected its renewal that overcomes its excuses and facilitates a return to a normal situation".

In a statement, collected by Europa Press, JJpD has regretted "the current interim" of the governing body of the judges, which this Sunday celebrated its four-year expiration date. "The Judiciary is the guarantor of the rights and freedoms of all people, so the precarious situation of its governing body is intolerable," he pointed out.

The association has demanded that, on the eve of "such an important day" --in which the anniversary of the Constitution is commemorated-- the members of the Judiciary "who are preventing the Constitutional Court from completing its normal configuration, abandon their contempt to the fundamental norm.

"On the 44th anniversary of the Spanish Constitution of 1978, the judicial association wants to remember that the institutional system that was established there is in crisis, because constitutional bodies of special relevance, such as the CGPJ or the Constitutional Court, are being allowed to remain in office. or incomplete", he claimed.

In this context, JJpD has urged that they "comply with the legal mandate that requires them to designate two of their magistracies." "No excuse, no grievance, no circumstance justify the instability of the body that grants protection to people who consider that the fundamental rights and public liberties guaranteed by the Constitution are affected," the association has assured.

Thus, JJpD has asked "to return to the path of responsibility and democratic commitment." "Abandon partisan positions and act with a sense of state, ensuring the correct functioning of our Social and Democratic State of Law, in the way in which the Constitution has established and that is a guarantee of our freedoms," the statement continued.

In relation to the Magna Carta, the association has indicated that its birth after the dictatorship "represented a change" in the "political model that has favored the democratic, economic and social development of Spain."

"Now we are a different country, in which rights and freedoms are recognized and advance. It has been the constitutional framework that has allowed our country to progress in equality and rights. Thanks to the Constitution, our legal system regulates and guarantees equality, divorce , marriage of people of the same gender or the right to die with dignity. Advances that at the time overcame heated debates to allow greater freedom for society and those who make it up," JJpD opined.

In this sense, the association has stressed that "preserving these rights is the work of the citizens and their political representatives." "To ensure the proper functioning of the democratic system, the Constitution sets up institutions that must be respected, since they are a guarantee of a balance between the legislative, executive and judicial powers, and that there will be no abuse of power," he said.

From his point of view, "fundamental rights and public liberties have to be ensured by the public powers, which requires that the organizations that safeguard them fully operate."
