Independent Judicial Forum sees "zero" will to reform the election system of the CGPJ

MADRID, 10 Dic. (EUROPA PRESS) -

The association Foro Judicial Independiente (FJI) sees "zero" will to reform the election system of the General Council of the Judiciary (CGPJ), in view of the amendments presented by the Socialist Parliamentary Group and that of Unidas Podemos regarding the election of magistrates of the Constitutional Court.

"The reform shows once again the null will to reform the election system of the CGPJ for its election by the judges to depoliticize the body. Far from it, and in a growing escalation of politicization of the institutions, it is the third time that undertakes the reform of the Organic Law of the Judiciary, one to remove the power to make discretionary appointments from the acting CGPJ, the second to give it back the power to appoint the magistrates of the Constitutional Court and now the third to lower the majorities and eliminate control of suitability", highlighted the association in a statement sent this Saturday.

The association considers the amendment to eliminate the consensus in the majority and the verification made by the Constitutional Court of the candidates "very serious", and stresses that the legislative modifications "blamelessly seek control of the constitutional bodies, in line with the idea that winning an election gives the right to take over all institutions, especially those created for the control of power".

"Our Constitution and the Law designed a system of consensus through reinforced majorities that are being suppressed for the sake of absolute control of the party that at all times obtains the parliamentary majority," he stresses.

Likewise, the association has shown its concern for what it has considered a "progressive setback in areas of democracy and the rule of law that are incompatible with the rights of citizens and with European demands".

In this way, he points out that a democracy needs a system of counterweights of power, which "although they are not to the liking of the controlled entities or subjects, they assure the citizen a democratic exercise of the power that is granted to political representatives."
