First prisoner released by the Asturian courts after the approval of the "only yes and yes law"

The Second Section of the Provincial Court of Asturias has notified this Monday an order ordering the release of the man convicted of sexual assault, whose initials are M.B., from the Monterroso penitentiary center where he was serving a sentence and also agrees his expulsion from Spain for 10 years. He is therefore the first prisoner to be released by the Asturian courts after the entry into force of the new law of 'only yes is yes'.

The defendant had been sentenced by the Superior Court of Justice of Asturias in 2018 and ratified by the Supreme Court in 2019 for a crime of sexual assault through carnal access, to a sentence of 7 years in prison, as well as a ban for 7 years. to come closer than 500 meters to the victim and prohibition to establish written, verbal or visual contact with her by any means of communication during the aforementioned period of 7 years and to the measure of probation for 7 years; and as the author of a minor offense of injury, to the penalty of two months of fine with a daily fee of 2 euros.

The Order of the TSJA maintains that since the prisoner lacks authorization to reside in Spain and it is expected that on January 23, 2023 he will extinguish the sentence of 6 years in prison that he has imposed, without any other custodial sentence pending. , it is appropriate to agree on the replacement of the probation measure that was imposed in the sentence by the expulsion from the national territory for a period of ten years.
