The UN Human Rights Committee has ruled this Wednesday that Spain violated the political rights of former Catalan vice president Oriol Junqueras and former councilors Raül Romeva, Josep Rull and Jordi Turull by suspending them from their public functions after being prosecuted for rebellion because they did before there was a conviction for the 'procés'.

It reaches this conclusion after examining the complaint of the four former Catalan leaders who, during their preventive detention, presented their case before the Committee alleging that the suspension of their functions, prior to the existence of a conviction, violated their political rights under article 25 of the International Covenant on Civil and Political Rights.

The Government of Spain, on the other hand, alleged that the four agreed to be replaced by other deputies from their parliamentary group while their suspension lasted. And he pointed out that, except for Romeva, "the authors resigned on May 17, 2019 from their act of autonomous deputies to assume as deputies in the Congress of Deputies" after being elected in the general elections of April 2019.

In addition, the legal services of the State recalled that on October 14, 2019, the Criminal Chamber of the Supreme Court sentenced the authors not for the crime of rebellion but for that of sedition, and that "the suspension was immediately lifted of Romeva as regional deputy".

The opinion also states that the Government highlighted in its allegations to the complaint of the former members of the Government that on June 22, 2021, "for the sake of public utility, it pardoned the prison sentence of the authors."
