The National Court has confirmed the granting of the third prison degree and conditional release for a woman who was sentenced by a court in Bonn (Germany) in 2020 to five years and two months in prison for trying to introduce five kilos of cocaine.

This is stated in an order from the Penitentiary Surveillance Court of the National Court of July 20 in which it is noted that despite the appeal against the Prosecutor's Office, the inmate has already served more than half of the sentence, it is the first time that commits a crime, has correctly assumed the institutional regulations, has participated in the programmed activities in prison, has the support of his family and has a socially normalized behavior prior to his entry into prison.

For this reason, he gives the green light to his release and adds, in addition, that "the inmate recognizes the criminal acts and accepts their consequences" and the prognosis of recidivism is low. "She considers herself, because she is fully justified, worthy of the third degree," she added.

Legal sources consulted by Europa Press explain that the woman, a 31-year-old Spanish woman of Moroccan origin, began a romantic relationship with a Dutchman whom she met through social networks, and who invited her to take a romantic trip through Europe. But that trip ended in July 2019 when she was arrested and tried in Germany for trafficking.

The conviction became final in February 2020 and was 1,885 days in prison for a drug trafficking crime for possessing more than 5 kilograms of cocaine. The woman's relatives contacted the Ospina Abogados office, an expert in international criminal law, at the end of 2021 to get her to serve her sentence in a Spanish prison.

After the procedural journey of demanding that she be transferred to Spain, she finally arrived at the Madrid I Penitentiary Center, where she should finish her sentence, on which there were still more than 700 days of internment remaining.

But given that the inmate suffered from breast cancer that, according to the defense, could not be adequately treated in prison, and given her exemplary behavior in prison, semi-liberty was requested, something that the National Court has now considered good despite the opposition of the Prosecutor's Office.
