Catalonia, the Autonomous Community with the most evictions between April and June, the most processes for 'squatting' and the most bankruptcy proceedings

The Autonomous Community of Catalonia heads the list of autonomies with the highest number of evictions between the months of April and June 2022, the one that has initiated the most judicial processes for 'squatting' of homes and the largest number of bankruptcy proceedings has been registered, according to evidence in a statement from the General Council of the Judiciary (CGPJ), collected by Europa Press. Andalusia also stands out as the Autonomous Community with the most foreclosures in absolute terms, but Murcia is the one that registers the most if the comparison is made per capita.

The same text specifies that the evictions carried out by the judicial bodies in the second quarter of the year were 10,816, 6.5 percent less compared to the same period in 2021. Of these, evictions derived from foreclosures decreased by 16, 6%, while those motivated by non-payment of rent fell by 2%.

Even so, most of the 10,816 evictions carried out between April and June were due to non-payment of rent, 7,871, 72.8% of the total. Another 2,377 --22%-- were derived from foreclosures and the remaining 568 releases responded to other causes.

The community with the highest incidence in the second quarter was Catalonia, with 2,414 evictions, 22.3% at the national level, followed by Andalusia (1,922), the Valencian Community (1,524) and Madrid (999).

During the analyzed quarter, and according to the CGPJ report, a total of 6,242 foreclosures were presented, 18.3 percent less compared to the same period of the previous year.

By autonomous communities, Andalusia, with 1,392 (22.3% of the national total), registered the highest number of new cases. It was followed by Catalonia, with 1,197, the Valencian Community (1,043) and Madrid (616).

However, if the number of foreclosures filed per 100,000 inhabitants is analyzed, Murcia stands out in first place, with 25.7, ahead of the Valencian Community (20.5) and Andalusia, with 16.1 foreclosures.

Regarding verbal possessory procedures for illegal occupation of homes, they fell by 26.2 percent between April and June (779 new admissions), while 820 were resolved.

Catalonia was the community with the highest number of processes (178, 22.8% of the national total), ahead of Andalusia, with 148; Valencian Community, with 114, and the Madrid Community, with 59.

On the other hand, the Spanish courts registered a total of 5,798 competitions, 15.6 percent more than a year ago. Of these, 2,927 were about individuals who were not businessmen presented in the Courts of First Instance and First Instance and Instruction, and the remaining 2,871 were filed before the Mercantile Courts.

The 2,871 contests filed in the Commercial Courts increased by 22.6% compared to the same quarter of 2021, with Catalonia in the lead with 1,047, 36.5% of the total. Madrid followed, with 413; Valencian Community, with 346, and Andalusia, with 263.

Of the total insolvency proceedings filed in these judicial bodies, 1,361 correspond to business individuals, which increased by 58.1% compared to the second quarter of 2021, and 1,510 are from legal entities and suffered a year-on-year increase of 2 percent.

As for the contests presented by natural persons in the Courts of First Instance and First Instance and Instruction, a total of 2,927, the interannual increase was 9.4%. Catalonia was the territory with the highest number, 749, 25.6%, higher than Madrid, with 449; Andalusia, with 397, and the Valencian Community, with 341.

According to the data, the contests declared in the second quarter of 2022 in the Commercial Courts were 1,508, with an increase of 11.8 percent compared to the same period last year. Added to this figure are the 979 bankruptcy proceedings declared and concluded under article 470 of the Bankruptcy Law.

31.9% FEWER EREs

Between April and June of this year, a total of 133 contests reached the agreement phase (with a year-on-year increase of 27.9%), while a total of 899 began the liquidation phase, 14.1 percent more than in the same quarter last year.

And regarding the files of article 169 of the Bankruptcy Law, regarding the substantial modification of collective working conditions (ERE), 98 files were filed, 31.9% less than in the same quarter of 2021.

For its part, the demands for dismissal increased by 2 percent, to 28,753, with Catalonia as the community with the highest incidence (5,583, 19.4% of the national total), ahead of Madrid (5,100), Andalusia ( 4,555) and the Valencian Community (3,171).

In the Social Courts, the lawsuits for registered amount claims were 30,414, 5.4% less than in the second quarter of 2021. Of these, 5,149 were filed in Andalusia (16.9% of the total), 5,093 they were in Madrid and 3,720 in Catalonia.

Likewise, in the second quarter of the current year, 20,997 cases were filed in the courts specialized in abusive clauses, 37,022 were resolved and 185,354 were pending. 31,721 judgments were issued, of which 97.7% were upheld.
