The PSOE will have to finally cede four deputies to Junts so that those of Carles Puigdemont can constitute their own parliamentary group in Congress, since two would not be enough to reach the minimum required in the House rules, as confirmed to Europe Press socialist sources.

The term to constitute a group ends at 2:00 p.m. this Friday, although it will not be until next Monday when the Congress Table will study the documents presented and decide whether to give its approval. The authorization of their own group is a preliminary requirement of the independentistas to be able to talk about the investiture of Pedro Sánchez.

The Regulations of the Chamber establish that, to form a parliamentary group in Congress, it is required to have more than 15 deputies, or a minimum of five seats plus 5% of the votes of the whole of Spain or 15% in the constituencies where it is held. have attended.

But Esquerra Republicana and Junts, with their seven deputies each, do not reach 15% in all constituencies, only in two, and they do not even reach that percentage in Catalonia as a whole, so their constitution as their own group is in the eaves.

Sumar has already announced its intention to hand over two deputies to ERC so that those of Gabriel Rufián reach 15% of the autonomous community. Later those two deputies would leave the independence group to join Yolanda Díaz's.

The PSOE was also going to use the loan route and, although at first there was talk of two deputies, finally there will be four, since those of Junts were even further away than ERC from that 15% bar in the whole of Catalonia .

Specifically, the PSOE will hand over the two PSC deputies for Girona, Marc Lamuá and Blanca Cercas, and the two for Tarragona, Andreu Martín and Valle Mellado, so that their votes and percentages join those of Junts and thus reach the 15% average of the four Catalan constituencies. Then the four will leave to join the Socialist Group.

The transfer of deputies has been used in previous legislatures, such as when UPN joined CC so that the canaries had a group or the Forum helped UPyD reach 5% of the nation, but there is a precept in the regulation that can make it difficult things.

And it is that article 23.2 of the Regulation establishes that "in no case can deputies belonging to the same party constitute a separate Parliamentary Group", a measure that was adopted to avoid what happened in the Transition, when the PSOE was subdivided into socialist groups from Euskadi or Catalonia, in addition to Spanish.

In the current case, it could be interpreted that there are Sumar deputies in two different parliamentary groups (two in the ERC group and the rest with Yolanda Díaz's group) and the same in the case of the PSOE (four with Junts and the rest in the Grupo Socialist).

Once the groups are registered, the Governing body of the Chamber will be able to collect the pertinent legal reports to endorse its decision and give free rein to the ERC and Junts groups, taking advantage of the fact that PSOE and Sumar won the majority in the body of government of the Chamber.
