The judge of 'Democratic Tsunami' offers to impersonate the family of the French tourist who died in El Prat

Demand information from NATO, the EU and the Ministry of Transport about the "blockade" of the Catalan airport

MADRID, 27 Nov. (EUROPA PRESS) -

The judge investigating 'Tsunami Democràtic' has offered to appear to the family of the French tourist who died of a heart attack in the context of the riots that broke out in the fall of 2019 at the El Prat airport after the 'procés' ruling, considering which is a fundamental step to prove that they influenced his death, at the same time that he has requested information from various organizations about the incidents to determine if his entity deserves the classification of terrorism.

In a car, to which Europa Press has had access, the head of the Central Court of Instruction Number 6, Manuel García Castellón, insists that what happened on October 14, 2019 at the El Prat airport fits into terrorism crimes because it It is an aerial 'hub', therefore considered "critical infrastructure", whose "blockade" was intended to "seriously destabilize the functioning (...) of the economic or social structures of the State."

Over 31 pages, the instructor recounts what happened that day. Thus, he emphasizes that it began through a call from Tsunami Democràtic on social networks: "Everyone to the airport." A call, he specifies, that resulted in the arrival of 8,000 protesters at the El Prat facilities with the aim of "stopping the activity at the Barcelona airport."

García Castellón echoes the police reports received, according to which, "the entry and exit of people from vehicles to Terminal 1 was blocked," which "was completely unusable." He describes that "the assailants accessed the boarding area, managed to settle in front of the doors to access the planes, preventing passengers from accessing them, and managed to block the El Prat air control tower."

Regarding the latter, he emphasizes that, if the security forces had not managed to clear road access to the air traffic control tower, an action with which the protesters intended to prevent the replacement of the air traffic controllers, "a danger could have been caused to the safety of national and international air traffic".

However, there is no doubt that "the action endangered airport security" and "air security", with "a clear danger both to the integrity of the agents and to that of the assailants themselves, when the attack occurred." indiscriminate throwing of objects from everywhere", a danger "extendable to travelers" and that "could materialize in the death of the French citizen Jean Claude Scherzinger".

In this sense, the magistrate highlights that, although the information received from the courts that investigated the death and the forensic report speak of natural death due to a heart condition, the latter also indicates that "the diagnosis of this category is determined both by the pathological findings as well as the medical history and circumstances of death. "Precisely, those circumstances were the collapse of the airport, emphasizes García Castellón.

Along the same lines, he recalls the statements to the press by Scherzinger's daughter in which she stated that "she believes that the circumstances that occurred at the airport influenced her father's heart condition" to the point that she went so far as to say that "his death was because of this," asking the journalist if they could file a complaint.

For the judge, "this circumstance shows both that the timely offer of shares to Mr. Scherzinger's family must be made, with information on what they can do, and how, and the need to obtain Francine's statement. Scherzinger (his wife, who was with him that day), to know first-hand what happened." And to this end he orders to contact the French authorities.

On the other hand, the instructor refers to the economic damages caused by 'Tsunami Democràtic', estimating them at at least 1,793,018.25 euros, based on the assessments sent by the Ministry of Transport and the airlines themselves to the National Court. .

Of these, "Vueling was the most affected", with an economic damage of 978,000 euros, for the 169 flights canceled that day, to which are added the 815,018.25 euros indicated by the Ministry of Transport, Mobility and Urban Agenda for the material damage and loss of profits, although it points out that AENA raised that figure to 1,217,595 euros.

Thus, García Castellón requires more information from ENAIRE, a public business entity dependent on the Ministry of Transport, Mobility and AgendaUrbana; to the European Union Aviation Safety Agency (EASA); and to NATO, through the supreme allied commander in Europe (SACEUR), to specify the incidents recorded that day in El Prat and in national and international air traffic.

It also requests information from the Emergency Medical Service (SEM) about "all the medical incidents recorded" that day and, specifically, about "all the records they have from that day containing the circumstances relating to the death of Jean Claude Scherzinger." , the same request that he makes to 112, while he asks the Bellvitge Hospital, where he was transferred by helicopter, for the complete medical history of the French citizen.

Finally, the instructor adds that "the investigation has made it possible to verify that Tsunami Democràtic tried to influence the electoral process", so that "on November 1, 2019, on the occasion of the General Elections scheduled for November 10 , called on his followers through Twitter and Telegram to disobey the Central Electoral Board (JEC)."

Specifically, he recalls that during the day of reflection on November 9, "a series of cultural, political and festive activities were organized in all the cities, towns and neighborhoods of the territory of the Catalan autonomous community, thereby attempting to interfere in the electoral process".

In this regard, the JEC is asked to report "on the actions carried out in relation to the events that took place during the day of reflection", specifying whether "any request was made to prevent these acts from taking place, who and the result"; to Barcelona City Council and the Government Delegation, to report on the authorized acts; and to the Urban Police, about the actions carried out.

In any case, it instructs the Civil Guard to investigate whether during the events held on the day of reflection "proclamations, speeches, messages or any other act of a political nature expressly prohibited by the LOREG were made."
