The Prosecutor's Office has withdrawn its accusation and Vox has not spoken out in time

The Barcelona Court has archived the case in which the former CUP deputy, Anna Gabriel, was prosecuted for an alleged crime of disobedience for her alleged participation in the Unilateral Declaration of Independence (DUI).

In an order consulted by Europa Press this Friday, the court decides to archive the case because both Gabriel and the Prosecutor's Office asked to do so and the other accusation, Vox, has not commented within the period it had to do so.

For this reason, the court has agreed to the free dismissal of the case and the definitive file, a decision that comes a year after the proceedings reached the Barcelona Court from the Supreme Court (TS).

The case was heard in the Supreme Court by the instructor of the 'procés', Pablo Llarena, and was transferred to Barcelona after both the Prosecutor's Office and Gabriel's defense claimed it because it was no longer certified.

The instructor concluded the summary after taking a statement from Gabriel, who voluntarily appeared in the Supreme Court after returning from Switzerland, where she had been since she was prosecuted in 2018 and where she currently lives.

At that time, the Prosecutor's Office asked to transfer the case to the Barcelona Court with the intention that this court would judge her accused of disobedience, but she finally gave up her accusation, considers that she did not commit any crime and has claimed the file that they have already agreed the judges.

During the investigation of the case, Gabriel testified in the Supreme Court and denied having committed a crime of disobedience due to his alleged involvement in the DUI.
