PP and PSOE register in Congress the proposal to reform Article 49 and ask that it be processed urgently

The parliamentary groups of the Popular Party and PSOE have presented this Friday, December 29, in the Congress of Deputies, the proposal for constitutional reform of article 49, while requesting that it be processed through the emergency procedure.

The initiative, to which Europa Press has had access, reflects that the reform of article 49 of the Spanish Constitution will come into force on the same day as the publication of its official text in the Official State Gazette (BOE).

The President of the Government, Pedro Sánchez, and the leader of the PP, Alberto Núnez Feijóo, reached the agreement to eliminate the term "diminished" from the Magna Carta in the meeting they held on December 22 in the Congress of Deputies. At this meeting, both parties agreed to present a bill in Congress before the end of the year with the joint signature of PSOE and PP and to hold a monographic plenary session on the matter in January 2024.

Currently, article 49 of the Constitution is worded as follows: "The public powers will carry out a policy of provision, treatment, rehabilitation and integration of the physically, sensory and mentally handicapped to whom they will provide the specialized attention they require and will protect them especially for the enjoy the rights that this Title grants to all citizens."

Organizations of people with disabilities have demanded reform to adapt the Spanish Constitution to the 2006 Convention on the Rights of People with Disabilities.

When the initiative presented by PP and PSOE is approved, article 49 will read as follows: "People with disabilities exercise the rights provided for in this Title in conditions of real and effective freedom and equality. The special protection that they provide will be regulated by law. necessary for said exercise".

Furthermore, the second point of the new article 49 states: "Public powers will promote policies that guarantee the personal autonomy and social inclusion of people with disabilities, in universally accessible environments. Likewise, they will encourage the participation of their organizations in the terms that the law establishes. The specific needs of women and minors with disabilities will be particularly addressed."
