An agent of the National Police has filed a complaint for the "sudden and non-consensual" kiss on the mouth that a woman gave him during the device against the independence referendum of October 1, 2017, considering that it may constitute a crime against sexual freedom.

"My reaction, in addition to disgust, was one of contention due to the extreme violence," he says, recounting that he was insulted by the woman and then, when she realized that there were media cameras, she decided to grab him with both hands, "immobilizing him." to give him a kiss on the mouth.

The document, consulted by Europa Press, was presented on September 11 before the Investigative Court number 7 of Barcelona by an agent of the Police Intervention Unit (UIP), known as 'riot police', who were deployed in Barcelona in October 2017 to comply with the court order to prevent the independence referendum.

The agent demands that the woman be identified, for which he offers an image and a link to a video published on a YouTube channel where the kiss can be seen, as well as that the precautionary measure of distancing one thousand meters from the complainant be imposed and the prohibition of communication with him by any means in order to protect the victim, that is, the police officer.

The events occurred on Vía Augusta Street in front of the Central Services of the Department of Education, used as a polling station, as can be seen in a video attached to the lawsuit that asks to identify the protester who, at a certain moment, kisses at the police officer, taking advantage of the fact that he had the protective visor of his helmet raised.

"An unknown person in a surprising, unexpected, sudden and non-consensual manner," says the National Police agent, "gives me a kiss on the mouth, constituting a crime against sexual freedom under article 181 et seq. of the Penal Code." .

The police officer, one of the 45 agents prosecuted for action to stop 1-O, adds that he received the kiss when the members of the State Security Forces and Corps "had just intervened in the electoral polls and while the withdrawal began of the acting officials between shouts, insults, attacks and humiliation".

"A woman of about 60 years old approaches me, insults me, and upon observing that a camera was close to both of us, she grabs me with both hands by the neck and the riot helmet that I was wearing when I was in uniform, surprisingly immobilizing me, and bringing my head to his, and then kiss my mouth with his," explains the UIP police officer.

The judicial brief highlights the atmosphere of "extreme environmental violence" and the "libidinous mood", warning that a reaction from the police could have triggered an increase in tension. "My reaction, in addition to disgust, was one of contention in the face of the extreme violence that we experienced in each school," he continues.

"By holding on to the lower part of the helmet, I cannot free myself or prevent it from bending my back, all while trying to avoid having a sudden response to the abuse that could trigger a situation of even greater risk to the integrity of the actors than I already had." we were enduring," adds the national police officer.

The Unified Police Union (SUP) has legally supported this agent's complaint and has urged public authorities to make all the tools and guarantees of the rule of law available to this police officer.

"We continue with a judicial procedure where 45 police officers were charged, while we received stones, humiliation, physical attacks and even sexual assaults like this case," the SUP denounced.
