The Supreme Court (TS) of Brazil has declared itself competent this Monday to investigate the soldiers who allegedly participated in the January 8 assault on democratic institutions in the country's capital, Brasilia.

"I establish the competence of the Federal Supreme Court to prosecute and judge the crimes that occurred on January 8, 2023, regardless of whether those investigated are civilians or military," Judge Alexandre de Moraes explained, according to the newspaper 'O Globo'. .

Thus, it has rejected that the military justice be the one to judge the crimes allegedly committed by the members of the Army --including threats, incitement to crime, coup d'état--, since the soldiers would have violated criminal types and typified in the Criminal Code, in reference to the attacks against the democratic regime, De Moraes pointed out.

The magistrate has subsequently opened an investigation into the participation of members of the Military Police of the Federal District and the Army in the assault on the three powers, in order to "determine the authorship and materiality of possible crimes."

De Moraes has made this decision after the request of the Federal Police, which assured that there was a possible collaboration or omission on the part of the soldiers who were in charge of the Institutional Security Office and the Presidential Guard.
