The TSJC reduces a sentence for sexual assault in Girona by two years due to the law of 'only yes is yes'

The Superior Court of Justice of Catalonia (TSJC) has reduced a sentence from the Girona Court for sexual assault from six and a half years to four and a half years by reviewing it for the application of the 'only yes is yes' law.

The sentence, consulted this Wednesday by Europa Press, states that when he was sentenced the minimum sentence for this crime was six years in prison, and the magistrates want to "be faithful" to the reasoning of the first court by sentencing him to the minimum sentence plus six months.

The man was sentenced in May 2022 for a sexual assault committed on April 20, 2019, when he was 19 years old and the victim 18, when leaving a nightclub in Platja d'Aro.

The two, who were friends, shared a taxi to go to his house to sleep, and there he went to the room where the girl was sleeping and sexually assaulted her.

The first sentence had also convicted him of another attempted sexual assault on the same young woman, but now the TSJC acquits him of this attempted crime because, as it happened in the same place and in a short space of time, the court considers it the same fact.
