The Supreme Court has admitted for processing the lawsuit filed by the Hay Derecho Foundation against the appointment of Magdalena Valerio as president of the Council of State, considering that she did not meet one of the main requirements for the position: being a renowned jurist.

Through a statement, collected by Europa Press, the general secretary of the foundation, Elisa de la Nuez, has assured that "the rapid formalization of the lawsuit may reflect the interest of the Supreme Court in a matter of great institutional importance".

Hay Derecho maintains that, in his lawsuit, he expresses his "deep concern about the impact that the appointment of a president who does not comply with one may have on both the proper functioning and the reputation of the highest advisory body of the Government of Spain". of the requirements, in addition to the precedent that it can set for other cases where it is also necessary to be a lawyer of recognized prestige.

"From the experience accredited through the Council of State website, it can be deduced that she is an official belonging to a management body with category A2, with a very relevant political career, as well as extensive experience in State affairs, but who can hardly be considered a jurist of recognized prestige no matter how broad one wants to give the indeterminate legal concept", De la Nuez pointed out.

For Hay Derecho "it is manifestly worrying" that already in the very appearance before the Commission of the Congress of Deputies that endorsed her appointment, the candidate pointed out that she never put on the toga as a lawyer, or that her tasks in a law firm consisted of review sentences.

The foundation has also criticized that Valerio used the time of the appearance to talk about his political career or even personal issues without relevance to the suitability that should be assessed: occupy the position of president of the Council of State.

In its claim, Hay Derecho invokes the jurisprudence established by the Supreme Court itself "from which it can be deduced that jurists of recognized prestige are perfectly recognizable due to their extensive professional career linked to Law."

"In addition, it understands that it must manifest itself publicly and externally through tasks such as the issuance of sentences, opinions, activity in the forum, conferences, teaching, publications, belonging to editorial boards or editorial boards of specialized magazines or blogs, the Royal Jurisprudence and Legislation Academy, General Codification Commission or other specialized legal bodies," adds the foundation.

Finally, Hay Derecho argues that, according to jurisprudence, political positions that have been held cannot be counted either, given that for their performance, logically, it is not necessary to have a law degree or have accredited prior professional legal experience.
