The former vice president of the Constitutional Court (TC) Eugeni Gay has described as "surprising and unusual" the decision of this court, which on Monday admitted the very precautionary measures of the PP to urgently suspend the parliamentary process of two amendments to modify the system of election of the two candidates for the TC appointed by the General Council of the Judiciary (CGPJ).

"Normally the TC, which is the highest interpreter of the Constitution, interprets when the political powers have made the final act", he stated in an interview this Tuesday with La 2 and Ràdio 4 collected by Europa Press, pointing out the difference with this case, in which the court has intervened during the parliamentary process.

Asked if the TC can paralyze the action of the Cortes, he replied: "The TC cannot paralyze neither the action of justice, nor the action of the legislator of the action of the executive until it has complied with it. When asked if the judicial decision represents a political victory for the PP, he replied: "It is not a political victory, what is happening is a defeat for everyone" which he believes begins with the delay in renewing the CGPJ.

"This would not have happened if the charges had been renewed at the time," he reproached the political groups responsible for renewing the members of the CGPJ.

The very precautionary statements that he presented to the PP questioned the mechanism that had been chosen to change the renewal process of the governing body of judges and, when asked if choosing this mechanism was a mistake on the part of the PSOE, Gay replied that "it has been risky , certainly, because it does not seem the most suitable way".

He has criticized that they wanted to make the change urgently: "If it was such a worrying issue, we have had a very long legislature, it seems that it has been temporary. I understand the tactics and strategies but I do not share that they do it in the eyes of all Spaniards, that we do not deserve this treatment".
