The Court of Barcelona dictates the first conviction for sexual assault with the law of 'only yes is yes'

It imposes 7 and a half years in prison and points out that it would have been the same sentence with the previous law because there was violence

The Court of Barcelona has sentenced a man to seven and a half years in prison for sexually assaulting a minor applying the 'only yes is yes' law, the first sentence of this court applying this law.

In a statement this Monday, the Superior Court of Justice of Catalonia (TSJC) has explained that, in the same sentence, the court has acquitted him of an offense of illegal detention for which he was tried because it has not been proven that he committed it.

He has also imposed a restraining order and a measure of probation for seven and a half years after leaving prison, in addition to compensation for the victim that exceeds 10,500 euros.

Regarding the application of the new law, the court points out that in this specific case the law of 'only yes is yes' does not benefit the defendant if it is proven that he used violence or intimidation.

"The penalty would be the same, although now the fork in the basic type has been lowered. The use of violence or intimidation is the most relevant objective element," the magistrates point out.

They add that, at the time of sentencing, the previous law and the current one "give rise to the application of the same penalty as long as they remain in tune with the theses of the prosecution, that violence was mediated", which the court considers proven. .
