The Court of Alicante releases a second man convicted of a sexual assault by the law of 'only yes is yes'

The Provincial Court of Alicante has released a second man convicted of sexual assault after the interpretation of the law of 'only yes is yes', according to the resolution provided by the Superior Court of Justice of the Valencian Community (TSJCV) .

Recently, 13 orders have been issued by different sections of the Court of Alicante in which the review of sentences for those convicted of crimes against sexual integrity in application of the reform of the Penal Code operated by Organic Law 6/22 is agreed, known as the 'only yes is yes' law.

One of the orders issued by the Court entails the immediate release of the prisoner. With these resolutions there are already 15 sentence modifications - in two cases with the release of the prisoner - issued to date by the Alicante Court.

Regarding the second order of release, it is about a man convicted in a final sentence on December 17, 2013 for a crime of sexual assault with penetration and with the aggravating circumstance of kinship because the victim is a wife or woman who is or has been linked to to the aggressor by analogous affective relationship, even without cohabitation.

In the rest of the cars reviewed, the courts agree to lower the following sentences: for a convicted person, the sentence of six years and one day fixed at the time is lowered to four years and one day in prison; for another, from six to four years; for another one, from 10 years and one day to nine years and one day; and for two more, from 10 to four years, and from nine to eight years in prison.

Likewise, in another resolution, the Court lowers the sentence of a prisoner from five to two years; in another, from nine to eight years and one day in jail; from six to four years; from four years and one month to two years, 11 months and 29 days; from 11 years in prison to 10 years, six months and one day; another prisoner is sentenced to six and a half years in prison instead of the eight and a half for which he was sentenced; and two other convicts will go from six years for a crime of rape to four.
