The conservative sector of the General Council of the Judiciary (CGPJ) considers it "essential" to resume negotiations with the progressive wing to agree on the two candidates for the Constitutional Court (TC) that corresponds to appoint the governing body of the judges, according to what has been established in a meeting held on Wednesday night.

According to sources familiar with said conclave, the nine members who have participated in it have agreed that in the coming days they will resume contacts to determine which are the appropriate candidates and who are willing to go to the court of guarantees to decide on a short list. of possible candidates from the conservative sector.

Sources from the CGPJ consulted by Europa Press already anticipated that, after the failure of the negotiations between the Government and the PP to renew the Council, the talks between conservative and progressive members would be reactivated to nominate their magistrates of the Constitutional Court.

The last meeting of the negotiating commission was on October 5. Then, the contacts ran aground and the progressive interlocutors decided to open them to the rest of the members, beyond the conservative spokesmen. As this news agency learned, the agreement was practically closed when Carlos Lesmes announced his resignation.

The aforementioned sources explain that what has happened since then has managed to heal relations between the conservative and progressive currents of the CGPJ to the point that some names are already being considered, such as the magistrates of the Supreme Court (TS) José Manuel Bandrés and Pablo Lucas, the president interim of the TS Francisco Marín Castán or the former attorney general of the State Julián Sánchez Melgar.

However, the same sources indicate that nothing is sealed yet. In fact, the conservative sector is considering contacting other Supreme Court magistrates who once ruled out for the Constitutional Court, understanding that the breakdown of negotiations between 'popular' and socialists draws a new scenario.

On the other hand, during their meeting on Wednesday night, the conservative members agreed to study measures to alleviate the crisis situation generated by the reform of the Organic Law of the Judiciary (LOPJ) promoted by the Government to prevent an acting Council , like the current one, will make discretionary appointments in the high courts.

Thus, in the coming days they will formulate specific proposals based on the information provided by the Inspection Service of the CGPJ. The aforementioned sources told Europa Press that one of the options was to recover the 'plan b' devised in the times of Lesmes to relieve the TS, which would involve resorting to reinforcement plans, service commissions and even professors and senior officials

In this sense, the conservative members insist that it is "essential" that the aforementioned legal reform, which was approved in March 2021, be repealed due to the magnitude of the damage it is causing in the normal functioning of the administration of justice, therefore, they have urged the Government to reconsider this modification of the LOPJ.
