The defense of the former president of the Government Carles Puigdemont will challenge the appeals of the Prosecutor's Office and the State Attorney's Office against the order of Supreme Court (TS) magistrate Pablo Llarena, in which they asked to prosecute him for aggravated public disorder as well as for disobedience and aggravated embezzlement.

Puigdemont's defense sources have explained that they have not yet been transferred the resources but that, when they receive them, they will challenge them.

Yes, they have already received the appeal from Vox, "which adheres to that of the Prosecutor's Office and does not say anything else", and they will also challenge it.

Puigdemont's defense is confident that a Euro arrest warrant for aggravated disorders would not prosper because, as they point out, the jurisprudence of the Court of Justice of the European Union (CJEU) stipulates that the applicable law is the one in force at the time of the facts , and not the one in force at the time of the claim.

On January 12, Llarena eliminated the crime of sedition from the prosecution against Puigdemont, but maintained the embezzlement and included disobedience, and the State Prosecutor's Office and the State Attorney's Office have appealed this order asking the investigator to also prosecute the former president for aggravated disorders.

Puigdemont's defense has recalled that this order - which also affects former ministers Toni Comín, Clara Ponsatí and Lluís Puig - annuls the European Arrest and Surrender Order (OEDE) that he had issued and for which he needed a request of the European Parliament.

The Belgian Justice has already refused to execute the Euro-warrant that weighed on Puig and has paralyzed those that affect MEPs until the European justice resolves the appeal against the suspension of their immunities.

They affirm that, for a new Eurowarrant, another request would be necessary: ​​the first had been requested for sedition, a crime already suppressed from the Penal Code.

Next Tuesday, the CJEU plans to respond to the preliminary questions raised by Llarena on the scope of the Euro-orders issued on the leaders of 1-O.

A second ruling by the European court is also pending, which is expected to be known in the first quarter of 2023, on the appeal that Puigdemont, Comín and Ponsatí filed against the decision of the European Parliament to suspend their parliamentary immunity so that they can be tried in Spain.
