VITORIA, 20 Dic. (EUROPA PRESS) -

The Provincial Court of Álava has ordered the release, as of this Tuesday, December 20, of a man who touched the buttocks of four girls under 16 years of age and another of legal age while they were skating on an ice rink in Vitoria-Gasteiz, whose sentence was reduced last Thursday by the Supreme Court from nine years to four years and six months in prison, in application of what is known as the 'only yes is yes' law.

Through an order dated this past Monday, and collected by Europa Press, the Álava Court recalls that this person had been in prison since December 23, 2019, after being arrested the day before.

The Provincial Court of Álava also recalls that on December 15 it received a communication from the Supreme Court "indicating that the appeal for cassation filed by the convicted person has been deliberated and it has been upheld."

The court order issued this past Monday indicates that the Supreme Court communication "indicates, in the operative part of the resolution that will be issued, that the maximum limit of compliance will be three years in prison, in accordance with the provisions of Article 76 of the Penal Code."

The Álava High Court notes that "in this proceeding there is a peculiar situation", given that although it already has the decision of the Supreme Court ruling definitively setting the sentence to be served, it has not yet received "the sentence itself".

In any case, in the order of this past Monday of the Hearing it is indicated that "with this information it can be determined that the prisoner will complete the expiration of the sentence that will be imposed tomorrow, December 20, 2022, the date on who will serve three years (1,095 days) in prison".

In this way, he adds that "it is appropriate to agree on his release" and release on December 20, 2022 "for serving the sentence."

The resolution of the Álava High Court is not final and an appeal can be made against it within three days from its notification.
