José Luis Moreno compares 'Titella' with the 'Cursach case': "It's a total and resounding failure of Justice"

He denounces a "general cause luck" against him: "It is a prospective investigation"

MADRID, 13 Dic. (EUROPA PRESS) -

The television producer José Luis Moreno, the main person under investigation in the framework of 'Operation Titella', has compared this case that is being investigated in the National Court with the so-called 'Cursach case', while criticizing what he considers "a total and resounding failure of the Administration of Justice".

In a letter addressed to the Central Court of Instruction Number 2, to which Europa Press has had access, the ventriloquist traces supposed similarities of this investigation with the circumstances that involved the investigation and the subsequent trial of the alleged corruption plot led by the Mallorcan businessman Bartholomew Cursach.

Specifically, Moreno's defense focuses on the report issued by the prosecutor Tomás Herranz before the Provincial Court of Palma in which he denounced that during the investigation phase "the most elementary practices of an impartial investigation were left aside". In addition, he accused the examining magistrate, another prosecutor and the money laundering group of "slander", which "undermined the reputation of the defendants."

"The report, concluded the representative of the Public Prosecutor's Office, 'more than justifying before the courtroom the withdrawal of the accusation, it has another objective. Recognizing before the defendants that they have suffered injustice. The change of the Prosecutor's Office is due to a minimal attempt to repair the damage.' The similarities with what is happening in this case are more than evident," argues Moreno's representation.

In this context, it criticizes that "the present criminal investigation is directed against" Moreno "on the basis of statements made in the briefs of certain private accusations and in police reports that, far from the neatness and rigor that would be required of them, lack of all probative or indicative support, exhausting itself in its single statement".

"It also happens that when this defense manifests the falsity of such assertions, and requests the practice of investigative procedures to demonstrate such falsity, all our evidentiary claims are systematically rejected, reducing to nothing our Fundamental Right to effective judicial protection and to defense", laments the letter.

All this, they argue, "causes the death" of Moreno "in all areas of his life." And it is that, "in addition to the total blockade" of his assets, "to the point that he is prevented from attending to his most basic vital needs." Likewise, he denounces the "constant interested and biased leaks of the proceedings to the media."

In the opinion of his defense, "nothing remains of the initial investigation for alleged fraud against banking entities and third parties for the alleged non-existence of the series 'Glow

From his point of view, "the proceedings carried out in this case allow us to affirm for months" that Moreno "has not done anything criminal." "However, far from rectifying and agreeing to the due dismissal, it is opted against the law to mutate the object of the procedure, to see what I catch (which, by the way, nothing is caught either, because there is nothing to catch). But it also doesn't matter," he insists.

At this point, Moreno's representation again points out the alleged similarities with the 'Cursach case': "This procedure, like the one mentioned, constitutes a total and resounding failure of the Administration of Justice. There is no possible repair for the damage already caused " , affects.

In spite of everything, the defense of the television producer considers that "there is still time to rectify". "It only takes courage to do it. They have already shown us the way forward," he concludes.
