The Ombudsman of Navarra has sent to the national office of the Ombudsman, led by Ángel Gabilondo, and to the Government Delegation in the regional community the complaint sent by the professional association JUCIL claiming that "the commission of a crime of hate" in the 'Ospa Eguna' that this Saturday will ask again in Alsasua for the expulsion of the State Security Forces and Bodies.

In a letter in response to JUCIL to which Europa Press has had access, the Ombudsman of Navarra, Patxi Vera, assures that he has "carefully studied" the request of the representatives of the civil guards, deducing that the complaint in question "does not is subject to the scope of supervision" of your office in accordance with article 1.3 of Provincial Law 4/2000.

For this reason, Vera points out that he has transferred the complaint for the 'Ospa Eguna' (Goodbye Day) on September 3 to the Ombudsman appointed by the Cortes Generales, since the latter "does have the competence to supervise the actions of the State Administration, in order for it to decide on the matter", as stated in the letter to which Europa Press has had access.

Following this decision, it is the Office of Ángel Gabilondo, a former socialist minister, who will handle the complaint and, where appropriate, "will report on its admission and processing." In addition, Vera offers to answer any questions or as a channel to send the Ombudsman additional documentation.

"In view of the nature of the matter," he continues, "I have thought it pertinent to inform the Government Delegation in Navarra of this problem, so that it can also assess the adoption of measures in this regard."

The general secretary of JUCIL, Ernesto Vilariño, thanked the Navarre Ombudsman for its response, which, although it does not satisfy his request, at least shows interest in having the demand addressed by the corresponding entity.

"We are now waiting to find out what the response will be from the Ministry of the Interior and the State Attorney General's Office, institutions to which we have also addressed so that, for yet another year, the derision, insult and humiliation that the organizers of the they direct this act in Alsasua, above all the civil guards and their families", Vilariño maintained.

JUCIL is one of the groups that has pressured public institutions to ban the event organized every year by the environment of the nationalist left. To do this, it asks that the "necessary administrative and judicial means" be applied, considering that the call "pursues as its sole purpose the humiliation, harassment and attack" towards the civil guards and also the victims of terrorism.

Every summer it is common for police organizations and groups of victims to request the prohibition of the 'Ospa Eguna' (Goodbye Day) in Alsasua, the municipality in which two agents of the Institute were attacked at dawn on October 15, 2016. Armado and his partners when they were inside a bar, which is why eight involved were sentenced to prison terms.

In the summer of 2019, the Prosecutor's Office of the National High Court requested the banning of the 'Ospa Eguna' -which has been organized at least since 2010-- on the grounds that it reproduces ETA's "tactical objective" consisting of expelling the Forces and Corps of State Security of the autonomous communities of the Basque Country and Navarra and which, furthermore, humiliates the victims of terrorism.

However, the head of the Central Court of Instruction number 2 of the National High Court, Ismael Moreno, issued an order in which he rejected the prohibition, considering that there was no history of crimes in previous celebrations that would justify such a restriction of fundamental rights.

The judge ordered, however, to send an official letter to the Department of the Interior of the Government of Navarra and to the State Security Forces and Bodies so that they could control the 'Ospa Eguna', in order to prevent crimes of glorification, justification of terrorism, humiliation of victims or others. If this happened, he wanted the perpetrators to be identified and brought to the attention of the court.
