The Vacation Room of the Superior Court of Justice of Catalonia (TSJC) has rejected the appeal of the Assembly for a Bilingual School (AEB) against the instructions for starting the course of the Ministry of Education of the Generalitat for public and concerted centers. In this resource, the association requested that a precautionary measure be issued that would imply that "at least one subject, matter, area or activity of a core or analogous nature" be taught in Spanish.

In a car consulted by Europa Press, the TSJC recalls that the Fifth Chamber denied on July 28 to dismiss the urgent precautionary measure requested and cited that within ten days the Generalitat ruled on the precautionary measure requested by the AEB.

Both the Lawyer of the Generalitat who presented a brief on August 11 and the prosecutor who issued a report that entered the court on August 22 took a position against the adoption of the precautionary measure.

In its order of August 26, the Vacation Chamber of the TSJC on duty remarks that in the appeal where the measure is requested, it shows that the object of the precautionary measure coincides with the object of the appeal filed, so it would practically advance the estimate of the appeal, and sees "inadmissible" the lack of specification of the damages that would result in the event that the precautionary measure is not adopted.

"The lack of determination of the damages that should be avoided with the granting of the precautionary measure, shows that what is really intended is to advance the issuance of a resolution favorable to the appellant," the order states.

Therefore, the courtroom of the TSJC has indicated that there is no place for the precautionary measure requested "without, of course, prejudging the merits of the matter, since the required regulatory requirements are not met in the case."

In its appeal, the AEB recalled that the new government decree law on linguistic projects rejects the use of percentages in the use of languages, but in the opinion of the association "this is not an obstacle for the two official languages ​​to be vehicular in teaching university".

In a tweet collected by Europa Press, the AEB has considered "surprising that the prosecutor aligns with the Government" in opposition to the precautionary measures, and sources from the association have explained that they will file an appeal against the decision of the TSJC.
