He raises his proposal in an amendment to the organic law project of organizational efficiency of the public service of Justice

The PSOE has proposed to modify the Organic Law of the Judiciary to expand the powers of the National High Court so that it is in charge of judging the crimes of smuggling of defense material and dual-use technology.

This is stated in an amendment registered by the Socialist Group in Congress to the draft organic law on organizational efficiency of the public service of Justice, which, together with the draft law on procedural efficiency and the law on digital efficiency, constitutes the legislative basis of the plan Justice 2030, defended by the Ministry led by Pilar Llop.

In the amendment, to which Europa Press has had access, the PSOE explains that the behaviors related to the smuggling of defense material and dual-use products and technologies "require specialization, with sensitive reports for the defense and are related to structures complex financials. And they have also underlined that the materialization of part or all of these behaviors take place "in foreign territory and/or international waters."

Thus, the PSOE considers it pertinent that the knowledge of these crimes corresponds to the National High Court and to this end it proposes to modify article 65 of the Organic Law of the Judicial Power to include said competence.

Until now, the Criminal Chamber of the National Court is competent to prosecute crimes against the Crown, terrorism, as well as the counterfeiting of currency and the manufacture of false credit and debit cards and false traveler's checks, provided they are committed by criminal organizations or groups.

In addition, crimes related to drug or narcotic trafficking, food fraud and pharmaceutical or medicinal substance fraud are added, provided that they are committed by gangs or organized groups and produce effects in more than one autonomous community.

This body also corresponds to fraud and machinations to alter the price of things that produce or may produce serious repercussions on the security of commercial traffic, on the national economy or property damage in a generality of people in the national territory.

In turn, the list includes crimes committed outside the national territory, when according to the laws or treaties, their prosecution corresponds to the Spanish courts; and certain crimes attributed to the European Public Prosecutor's Office when it has decided to exercise its competence.
