The PP led by Alberto Núñez Feijóo has celebrated this Thursday that the General Advocate of the Court of Justice of the European Union (CJEU) has agreed with the Spanish Justice on the euroorder against Belgium, thus opening the way for the delivery of the former president Catalan Carles Puigdemont. In his opinion, it is "very good news for the democrats against the fugitives from justice" and he hopes that the EU Court of Justice will rule in the same direction and pass sentence soon.

This has been assured by the PP spokesperson in Brussels, Dolors Montserrat, and the MEP Javier Zarzalejos, after learning that the CJEU has considered that the Belgian Justice cannot reject the delivery of those accused by the 'procés' claimed by the magistrate of the Supreme Court Pablo Llarena, including Puigdemont, based on the risk that their fundamental rights will be violated if they do not demonstrate systemic and generalized deficiencies in Spain, nor can they question the powers of the Supreme Court as the authority to issue such European orders.

The opinion of the Advocate General of the CJEU is not binding for the European Court of Justice, but in the vast majority of cases the sentences issued by the European Justice follow the line marked by these opinions.

Montserrat welcomed the decision because, as she stressed, these pro-independence leaders "dealt a blow to Spanish democracy and it is before the Spanish justice system that they must respond." In her opinion, "the fugitives cannot escape from their crimes committed in Spain for which they must be tried."

"This is very good news for the democrats in the face of the fugitives from justice. We want the EU Court of Justice to go in the same direction and pass judgment soon," said Montserrat, according to a statement released by the PP .

In the same way, the MEP Javier Zarzalejos has assured that they should congratulate themselves for this decision of the General Advocate that "reaffirms the spirit and the letter of the Euroorder". In his opinion, "with this opinion he puts an end to the deviated application of the Belgian courts that has rejected the delivery of those who are accused of very serious crimes."

"I hope that soon the Court of Justice of the EU issues the sentence and accepts the thesis of the attorney general so that sooner rather than later the fugitives can render responsibilities before the Spanish courts," he said.

In addition, Zarzalejos has stated that "it is very important to restore mutual trust so that judicial cooperation is strengthened." "This is very good news for the health of a fundamental tool for the proper functioning of the EU's area of ​​freedom, security and justice", he stressed.

In his opinion, Schengen is one of the main achievements of the EU, but "it cannot become an escape hatch for those who in any European country try to avoid the action of justice".
