The Madrid courts begin the judicial year pending reports in Neurona and Pegasus

MADRID, 3 Sep. (EUROPA PRESS) -

The Madrid courts begin the judicial year pending expert reports, statements and appeals in their most mediatic cases; from the one related to the costs of the work carried out by the consultancy Neurona to Podemos to the one linked to the alleged espionage with Pegasus to the lawyer of the former president of Catalonia Carlos Puigdemont.

The Court of Instruction Number 42 of Madrid is waiting for the expert report that it commissioned to determine the costs of the services provided by the consultant and that were included in the invoice of 363,000 euros -which it investigates in this case-, signed in the framework of the Podemos campaign for the April 2019 elections.

According to the judge, the "existing discrepancies" between the contract, the invoices and the services provided justified the report. For this reason, last November he ordered its redaction. In April of this year, however, it was still not done because the appointed expert refused, so the head of the Court ordered a new expert.

While waiting for said text, it was agreed not to extend the term of the investigation -which expired in July-. Vox, which exercises popular accusation, commissioned and presented an expert report with which it asked the judge to rectify his decision and extend the period of the investigations.

If he maintains his position and does not extend the investigation, the judge must wait for the commissioned expert report to be presented to the independent experts. When he has it in his hands, he will decide whether to go ahead with the procedure or file. In the event that new evidence appears in said report, he could reactivate the investigations and order new proceedings or summonses.

In the Court of Instruction Number 29 of Madrid they are also waiting for a report. Last July, a lawsuit filed by Gonzalo Boye - lawyer, among others, of former Catalan president Carles Puigdemont - was admitted for the alleged espionage that he claims to have suffered with the Pegasus program. The admission was partial, since the judge refused to investigate the Israeli company NSO, owner of the 'software'.

The head of the Court urged Boye to hand over the mobiles that have been "the object of attack" so that they can be sent to the Judicial Police and the agents write an expert report on whether or not there was "interference".

The procedure is awaiting said devices and the aforementioned expert text. At the moment, no interrogations have been agreed.

In that same Court, an investigation is being carried out on an alleged police network that offered former officials of the Government of Venezuela alleged influence in the Administration in exchange for large sums of money and information from Podemos. It is expected that on September 26 three alleged victims will declare, one of them, the former Vice Minister of Electrical Development of Venezuela Javier Ochoa Alvarado.

In addition to these citations, the magistrate has yet to take statements from the 13 people who appear as accused for being alleged members of the police network that is being investigated for alleged crimes of fraud and/or extortion. Everyone will have to testify on October 6. The 30 companies that are listed as being investigated still do not have a set date.

According to the reports of the case to which Europa Press has had access.

For its part, the so-called 'Plus Ultra case', in which alleged irregularities are investigated in the granting of aid of 53 million euros to the airline, is waiting for the Provincial Court of Madrid to respond to the appeal that it presented the company against the judge's decision to charge him and summon his legal representative to testify.

Said declaration was scheduled for June 15, but the head of the Investigating Court Number 15 of Madrid suspended it to study whether or not it complied with the request of the airline, which defended that its imputation was agreed outside the instruction period and Therefore, the decision was invalid. Finally, the judge confirmed the accusation.

Both the Prosecutor's Office and the State Attorney agreed with the airline. The accusations made by Manos Limpias, PP and Vox insisted on the need to carry out the interrogation.

In addition, proceedings are pending in the Court of First Instance and Instruction Number 4 of Majadahonda (Madrid), where the complaints filed by Clean Hands and by the leader of the National Training Center for Football Coaches (CENAFE) have accumulated. , Miguel Ángel Galán, against the president of the Royal Spanish Football Federation (RFEF), Luis Rubiales, and against the Barcelona Football Club player and owner of the Kosmos Global Holding company, Gerard Piqué, for alleged crimes of corruption in business and unfair administration.

The judge agreed last June to open preliminary proceedings as a result of the complaint filed by Galán, who pointed -among other issues- at the alleged commissions charged by the RFEF and Piqué's company for disputing the Spanish Super Cup in Saudi Arabia. In the Anti-Corruption Prosecutor's Office they had started some investigations in May, but, according to the tax sources consulted by Europa Press, the matter finally remains in Majadahonda.

At the end of August, the Investigating Court Number 44 of Madrid agreed to open proceedings after receiving the Clean Hands complaint and considered it pertinent to send the case to the Majadahonda court, given that the same reported events were already being investigated there.

In the Court of Instruction Number 52 of Madrid they are waiting for the judge to decide whether to admit the extension of the lawsuit in which fifty franchisees asked that Heineken also be investigated in the procedure that is being followed for alleged fraud, organization criminal, coercion and computer crimes against 29 companies linked to the Restalia Group, including 100 Montaditos, La Sureña and The Good Burger.

In the original complaint, the franchisees defended that Restalia and those responsible for the companies had, among other things, hidden the existence of agreements with suppliers that made the project "unfeasible".

Likewise, it is pending that the Court of First Instance Number 82 rule on the lawsuit filed by an individual against Vox to declare several articles of the party's internal regulations null and void. It should be remembered that the judge has already refused to reject in a precautionary manner the plaintiff's request to suspend the agreements by which the appointments of the candidates for the Andalusian elections on June 19 were made.

On the sidelines, the Court of First Instance Number 50 of Madrid will hold a hearing on precautionary measures on September 12 to study the request made by the same individual on the internal regulations of Izquierda Unida and its candidates.

In turn, the Investigating Court Number 26 of Madrid is pending proceedings in the proceeding against three government officials whom Vox accuses of having committed a series of irregularities for the acquisition of medical supplies at the beginning of the pandemic. .

The Prosecutor's Office requested the file of the case because, in his opinion, the formation led by Santiago Abascal has not specified "sufficiently" the "minimum" indications to carry out an investigation. The Court, however, extended the investigation period, so it is expected that it will order proceedings to clarify the facts.
