The Government reaches fifteen agreements with the Autonomous Communities in 2022 to avoid unconstitutionality appeals

MADRID, 8 Jul. (EUROPA PRESS) -

The Ministry of Territorial Policy has reached this month a new agreement with the Government of the Balearic Islands to avoid unconstitutionality appeals, specifically in the law to execute European funds, which adds up to a total of fifteen agreements so far this year on regional regulations with possible unconstitutional precepts.

The agreement reached with the Balearic Executive is on the law of extraordinary and urgent measures to execute the actions and projects that must be financed with European funds within the framework of the Recovery Plan.

As reported by the department headed by Isabel Rodríguez, in relation to articles 7, 19 and 22 of the law, both parties have agreed to refer the solution of the discrepancies to what was agreed in the Bilateral Commission since these precepts come from the decree law.

With regard to article 25, in relation to the possibility that the appointment to the direction of projects for the management of funds falls on official or statutory personnel through a service commission or a temporary assignment of functions in a temporary position of a managerial nature, the The Balearic Government will apply that the reference to civil servant or statutory personnel is limited to career civil servant or statutory personnel.

In relation to the fourth final provision of the law, both parties consider the discrepancy resolved, since the derogatory provision of the community budgets has repealed the aforementioned final provision.
