The European Parliament has examined the slow pace of Justice in Spain at the request of a Sevillian lawyer who has already requested protection from the Constitutional Court for having to wait more than three years for a trial.

The president of the Committee on Petitions of the European Parliament, Dolors Montserrat, has addressed a letter to the lawyer - to which Europa Press has had access - in which she informs him that her petition has been examined and has been declared "admissible" , since the matter "falls within the spheres of action of the European Union".

Montserrat, who specified that the petition "has recently been debated in the European Parliament", reminded the lawyer that, once the judicial procedure in Spain is over, "you can file a complaint with the European Court of Human Rights (ECHR) if considers that their individual rights have been violated".

The leader of the PP has informed that the Committee on Petitions "has decided to end the examination of her petition" and has thanked the lawyer for having transferred the complaint to the European Parliament.

Lawyer Daniel Sánchez Bernal is waiting for the Constitutional Court to rule on the amparo appeal he filed, considering that the right to effective judicial protection has been violated by having to wait more than three years for the trial to be held. for a labor lawsuit filed against the University of Seville.

On June 24, 2021, the Social Court Number 11 of Seville admitted the claim and announced to the lawyer that the conciliation act and the trial, in case the parties do not reach any agreement, were scheduled for June 7. November 2024. The court finally found a gap and will be held in December 2022.

The Prosecutor's Office of the Constitutional Court maintains that the fundamental right to a judicial process without undue delay has been violated. Prosecutor Fernando Cabedo has reported in favor of partially estimating the appeal filed by the plaintiff before the TC and declaring that his fundamental right has been violated, as stated in a letter dated July 12 to which Europa Press had access.

"The plaintiff's conduct does not deserve any reproach, given that, in addition to not having caused the delay in question, he has denounced the violation of the fundamental right," says the prosecutor, who adds to his reasoning the fact that the plaintiff appealed the first court refusals to change the trial date.
