THE BOE publishes the dismissal "by resignation" of Lesmes as president of the CGPJ and the Supreme Court

MADRID, 12 Oct. (EUROPA PRESS) -

The Official State Gazette (BOE) published this Wednesday the royal decree that provides for the dismissal "by resignation" of Carlos Lesmes Serrano as president of the General Council of the Judiciary (CGPJ) and the Supreme Court (TS).

Lesmes formalized his resignation as president of the CGPJ and the Supreme Court on Monday after announcing it on Sunday due to the lack of progress in the negotiations between PSOE and PP to renew the CGPJ.

Lesmes had already announced this Tuesday that he would not attend the National Holiday events despite the fact that his dismissal had not yet been published in the BOE, which happened this Wednesday.

This does not mean that the Judiciary will not be represented on October 12, since the members of the CGPJ, the members of the Government Chamber of the TS and the presidents of the different Superior Courts of Justice (TSJ) are always invited.

This implies that the two people who seem to dispute the head of the Judiciary could attend the celebrations: Marín Castán as a member of the Government Chamber of the TS and Rafael Mozo as a member of the CGPJ.

Both Lesmes and the Technical Cabinet of the TS maintain that the successor should be the Vice President of the Supreme Court, a position that Judge Francisco Marín Castán occupies on an interim basis, but from the CGPJ they consider that it is an imposition and threaten to resist by enthroning the oldest member , Raphael Mozo.
