The Criminal Chamber of the National Court (AN) has requested a new report from the Álava prison on Jon Etxeberría Oiarbide to resolve the appeal filed by the ETA member against the decision of the Prison Surveillance judge to deny him an exit permit of three days.

This is stated in a ruling dated May 18, to which Europa Press has had access, signed by the First Section, made up of magistrates María Riera, Francisco Javier Vieira and José Ricardo de Prada, the latter as rapporteur.

The judges demand that the Alava Penitentiary Center, where Etxeberría is currently serving his sentence, rule again on his current situation and the "circumstances that could be relevant in his prison evolution", "so that the court can rule in real time ( ...) in relation to the penitentiary evolution of the convict".

The First Section indicates that this new report is "necessary" to resolve the appeal filed by Etxeberría's defense against the decision adopted on December 20 by the Central Prison Surveillance Court to deny him an ordinary three-day exit permit. .

The magistrates consider it convenient to have an updated report, "given the time that has elapsed since the favorable report dated 08.10.2021 was issued by the Treatment Board of the El Dueso Penitentiary Center for the granting of the ordinary prison permit."

Etxeberría was serving a sentence in El Dueso (Cantabria) but was transferred to the Álava prison as part of the latest approaches. He was sentenced in 2019 to nine years in prison for a crime of depositing weapons and explosives for the ETA van intercepted in 2017 in Óbidos (Portugal). He has served three years of sentence out of the total of nine to which he was sentenced.
