Several professional associations of civil guards have shown their rejection of the Ministry of the Interior's proposal to modify the Personnel Regime Law with the objective that women represent 40% of the workforce, including a clause by which they will have preference over men. male candidates provided that, after passing the pass, the difference in points between them does not exceed 15%.

"We are in favor of facilitating the access of women in the Civil Guard but the proposal does them no favors; we want the best prepared to enter, regardless of sex or race," the legal manager of JUCIL, Alberto Alvarez.

In his opinion, the draft that modifies the Personnel Law violates article 14 of the Constitution. For this reason, he anticipates that, if the legislative modification is approved, they will urge the parliamentary groups to present an appeal of unconstitutionality. In addition, they will wait for oppositions to access the Civil Guard to appeal to the contentious-administrative courts.

"It's a real botch," says Pedro Carmona, AUGC spokesman, who maintains that, instead of promoting this change in the Civil Guard Personnel Regime Law, the Ministry of the Interior should tackle other chronic problems such as this body The police force lacks measures to "help geographical mobility, effective work-life balance, a culture of equality or a better remuneration policy".

The JUCIL representative elaborates on this idea when he maintains that the Civil Guard is the "worst paid" police force, which makes it unattractive for attracting talent. He also points to the rejection that can cause the continued application of the Military Penal Code or the deficiencies regarding shifts and destinations, in the majority in municipalities of the so-called emptied Spain.

The associations agree that the Civil Guard has chosen to imitate plans along the same lines already promoted by the Ertzaintza in the Basque Country. In addition, they complain about the "rush" for the draft to be approved by the Council of the Civil Guard before the end of the year, which would give way to the process of mandatory reports until its final approval in Parliament, although they doubt that it is Ready this legislature.

The modification is embedded in the strategy of the Ministry led by Fernando Grande-Marlaska, who in mid-September endorsed his commitment to promoting measures of "positive action to reach 40% of women before 2030" in the Security Forces and Bodies of the Condition.

At present, after 34 years of the first entry, women represent 8.97% of the staff in the Civil Guard, compared to 16.78% in the case of the National Police -where 43 years have passed since the first with women's access--, according to data from the Ministry of the Interior.

In this context, the National Police has just eliminated the minimum height requirement, also eliminating the "obstacles" in the gestation, childbirth or postpartum periods. In the case of the Civil Guard, Interior announced on September 14 that it was going to reserve a percentage of places for women in its selection processes.

After each selection process, the list of admitted applicants will be drawn up according to the score obtained in the different tests, but the Ministry added an appendix to "ensure coverage of the percentage of places reserved for women": henceforth women "will have preference over male candidates provided that, after passing the pass, the difference in points between the two does not exceed fifteen percent.

The draft, consulted by Europa Press, proposes to change article 35 of the Civil Guard Personnel Regime Law to admit "differences based on sex" in the selection systems, in addition to those already contemplated by "different physical conditions". .

For the applicants "disregarded" by the measures to support the entry of women, the norm contemplates -always according to the draft transferred to the associations- that "they have merits in the competition phase of the following selective processes for incorporation into the scale of corporals and guards, according to the scale established in the corresponding call".

In the 2019, 2020 and 2021 calls, a total of 56,321 applicants attended the Civil Guard entrance exams, of which 19,187 were women, 25.4%. Once these three calls were resolved, of the 5,097 approved, only 21% (1,358) were women, according to Interior data.
