The PP has registered this Friday a non-legal proposal for the Plenary of Congress to ask the Prime Minister, Pedro Sánchez, to dismiss the Minister of the Interior, Fernando Grande-Marlaska, for having dismissed Colonel Diego Pérez from the Civil Guard from los Cobos as head of the Madrid Civil Guard Command, a dismissal that has been annulled by the Supreme Court.

Specifically, the 'popular' propose that the Chamber urge Sánchez to remove Marlaska from the Government for "having acted with a misuse of power" by removing Pérez de los Cobos from his post for "not reporting the development of open criminal investigations that affected senior officials appointed by the Government".

In addition, they emphasize that the colonel did nothing more than obey the express order that the investigator of those cases had given to the Civil Guard regarding his "duty of legal reserve" an obligation that, if not fulfilled, "could lead to the commission of a criminal offence".

In this context, they point out that the "political order" to "strike down" and dismiss the colonel was "illegal" and that it brings together "all the ingredients of arbitrariness" that, from their point of view, usually permeate Marlaska's actions at the head of her department.

In the statement of reasons for its initiative, collected by Europa Press, the parliamentary group led by Cuca Gamarra mentions the unanimous ruling of the Supreme Court in which it is clear that "the order given by the Interior was contrary to the function of the Judicial Police" and highlights that the court itself, in addition to ordering the reinstatement of Pérez de los Cobos, "reprimands the minister for his inadmissible interference in a judicial investigation."

The PP also alludes to the "set of illegal decisions, contradictory explanations and repeated lies" to which, they denounce, the minister resorted to "hide the seriousness of the facts declared proven." Likewise, they accuse the head of the Interior "avoiding compliance with the Supreme Court's sentence" and resisting reinstating Pérez de los Cobos in his position.

But the PP does not limit its criticism to Pérez de los Cobos, but rather points out that it is "incomprehensible" that Marlaska continues in office after having to appear in the European Parliament for the management of the attack on the Valla de Melilla in June 2022, the outbreak of the 'Barracks case', the resignation of the former director of the Civil Guard, María Gámez and the end of the dispersal policy for ETA prisoners.

In his opinion, the position of the minister is already "untenable" from "the most elementary democratic principles" because, in addition, he has asked for the confidence of the citizenry.

"In no homologous democratic government could there be a chain of irregularities and controversies of such a level as those that affect the Minister of the Interior and that the President of the Government continues to keep him in his post," they conclude.

In statements to journalists in Elche, after visiting the Pikolinos production center together with the president of the PP of the Valencian Community, Carlos Mazón, Feijóo has affirmed that the "forceful" sentence of the TS on the dismissal of Pérez de los Cobos would have meant the immediate resignation of the Minister of the Interior in any other European country.
