The judge of the National Court Francisco de Jorge has asked the Prosecutor's Office to rule before deciding whether to admit to processing the complaint that the Dignity and Justice Association (DyJ) has filed against the leader of EH Bildu, Arnaldo Otegi, and against the former member of ETA José Aulestia, alias 'Zotxa', for the alleged crime of terrorist murder against Michelin director Luis María Hergueta in June 1980.

In an order, collected by Europa Press, the head of the Central Court of Instruction Number 1 initiates preliminary proceedings, informs the Public Ministry and requests a report on the accumulation of the complaint and documents attached to summary 24/2005 that is followed in that same judged as well as to express itself on the "admission for processing of the complaint, and, where appropriate, procedures to be carried out."

It should be remembered that, in its complaint, the association maintains that at the time of the murder Otegi "was a member of the Intervention General Staff of the terrorist organization ETA, a body that carried out the functions of the military apparatus and was in charge of terrorist actions following the orders of the Executive Committee" of the band.

The person responsible for it was 'Zotxa', says DyJ, "with Otegi acting as his lieutenant, "as proven by the organization chart of the terrorist organization ETA, at the time of the events investigated."

The complaint, collected by this news agency, refers to the kidnapping of the president of Michelin, Luis Abaitua, from whom information about Hergueta, among others, was allegedly extracted. In captivity, the association assures, Otegi "materially participated," and that information "would have been subsequently transmitted to his person in charge, with said information being valid and effective to order the commission of the terrorist murder of Hergueta."

Dignidad y Justicia remembers that it was on the morning of June 25, 1980, while Hergueta was walking down the street in Vitoria, when "three unidentified young men" approached him. "One of them shot him twice in the head, dying on the way to the Vitoria aid station, where the body was admitted," the letter states.

The association assures that these events could be provisionally classified as constituting the crime of terrorist murder. For all these reasons, DyJ asks the National Court to summon both Otegi and Aulestia to declare themselves under investigation.

Likewise, it requests that the Information Service of the Civil Guard and the General Information Commissariat of the National Police Corps be issued a report on the evolution of Otegi within the terrorist organization ETA and its inclusion and responsibility. in the Intervention General Staff.

Finally, it requests that the court of the National Court entitled by Judge Francisco de Jorge "attested copy of Summary 61/1979 investigated for the illegal detention of Abaitua, for which, among others, Otegi and Luis María Alcorta were convicted ".
