The acting Minister of Defense, Margarita Robles, has indicated this Thursday that the "reasonable" thing would have been for the Constitutional Court (TC) to have waited for the Plenary Session of the Chamber or for a section and not for the Vacation Chamber before an appeal of " political and legal significance" such as the one presented by the former Catalan president Carles Puigdemont.

"It would have been prudent if it had not been the Holiday Room that would have resolved it," said the magistrate in statements during a visit to the Operations Command at the Retamares Base in Madrid.

Robles considers, based on his "professional experience", that these types of chambers are for "matters of pure processing, of lesser incidence" and that the TC is an "essential" body made up of twelve magistrates, something that has contrasted with the small number of magistrates that make up the Holiday Chamber, which are three.

"It has not only political, but important legal significance," he insisted and precisely for this reason he considers that the "reasonable" thing to do would have been to wait for a section or the Plenary of the Chamber to be formed.

The Vacation Chamber of the Supreme Court, made up of two conservative magistrates and a progressive magistrate who opposed it, rejected the amparo appeal filed by Puigdemont and the former Catalan councilor Toni Comín against the arrest warrants issued by the Supreme Court for both of them for crimes of disobedience and embezzlement. But the Prosecutor's Office has announced an appeal to resolve the Plenary of the TC, already with a progressive majority.
