The Supreme Court has annulled the decision that it adopted last week to annul the oppositions to the National Police since a correction has been published in the Official State Gazette (BOE) that suppresses the reason for which it was annulled in the first place. place and it is clear that applicants with intraocular bodies or phakic lenses are not excluded.

The magistrates have issued an order this Monday, collected by Europa Press, in which they have annulled the annulment and have indicated that the resolution of the General Directorate of Police of November 15, 2022 (BOE of November 18, 2022 ) must be interpreted and applied in accordance with the corrections introduced in the BOE of November 30, 2022.

The High Court has thus responded to an allegation made by the State Attorney who, in a letter dated December 1, 2022, and given the fact that the correction of errors included in the BOE, makes the violation of the precautionary measure disappear. valid.

The Supreme Court, however, has reproached the Administration for "not reporting precisely and promptly the steps taken to remedy the violation of the precautionary measure."

The magistrates have insisted that, contrary to what the State Attorney affirms, the order issued last week "does not adopt a new precautionary measure, but is limited to safeguarding the effectiveness of one already in force."

Last week, the Supreme Court declared null and void a call for entry by the National Police considering that it included requirements that "at the moment" cannot be demanded.

Specifically, it annulled the resolution of the General Directorate of the National Police of November 15, 2022 calling for free opposition to fill student places at the National Police School, considering that it breached the precautionary measure established by the Supreme Court itself. in September 2021, when the exclusion related to carrying intraocular bodies or phakic lenses was suspended.

The magistrates of the Fourth Section of the Contentious-Administrative Chamber assured that the actions of the Corps "cause confusion and manifest lack of transparency regarding the conditions that must be met by those who aspire to participate in said opposition."

The court's decision responded to a brief submitted by some applicants who appealed Royal Decree 326/2021, which approved the medical list of exclusions for entry into the National Police. It is within the framework of this appeal that the Supreme Court agreed to the precautionary suspension of the aforementioned exclusions. The resolution of said appeal is still pending.
