The judge reminds the PP that the person cited in Salamanca was Feijóo and not his legal representative

The judge of First Instance Number 5 of Salamanca has reproached the PP for having attended a legal representative at the summons and not the president of the political formation, Alberto Núñez Feijóo, who was the one who was with his "name" summoned to go to the dependencies judicial proceedings this Friday, on the occasion of the demand of a group of thirteen party affiliates for the delay of close to two years of the Provincial Congress of the PP of Salamanca.

"The person who was summoned was Mr. Feijóo, who would have come and told me: I know absolutely nothing, I cannot inform you of anything, I cannot help you at all. He was the one who was summoned, the man who was not summoned was is now in front of me", pointed out the magistrate.

Regarding this meeting scheduled for 12:40 p.m., the lawyers representing the Popular Party have accessed minutes before 12:30 p.m. inside the Courts of Salamanca, in Plaza de Colón, without Núñez Feijóo having attended.

Moments later, the lawyers from the group of thirteen members of the Popular Party who have filed the lawsuit before the Court of First Instance number 5 for the delay since spring 2021, in the call for the Provincial Congress of the PP of Salamanca, have accessed the same offices. .

Already inside the room, the representative of the PP, as a defendant, has pointed out that the delay is the result of the situation derived from the pandemic, since, at the time that the call should have been held, "it was not reasonable".

"556 people in a venue in times of covid was not reasonable", he said in reference to "postponing the congress", as well as others, which he has later carried out for this reason, with a gradual "calendar" so as not to do "of hit and whack all at once".

Given this, he pointed out that the National Executive Committee has been approving them and that most have already been held, such as those of Madrid, Extremadura, Galicia or Mérida.

In specific reference to that of Salamanca, he has pointed out that, after the resignation of the president of the PP of Salamanca, Javier Iglesias, the creation of a manager has been approved that has the "purpose" of calling him soon.

That body, it has continued, must decide "the most appropriate date" and that, as the call for the municipal elections in May is, doing so now would mean "monopolizing the actions of all employees" and could entail "electoral damage". hence the interest in calling it "later" has advanced.

Given this, in addition to asking the plaintiff for a finance of 150,000 euros for the "electoral damage" that "could be caused" in the case of being summoned earlier, he has asked the judge to dismiss the demand and has listed sentences of the Supreme in line with the appreciations on his part and, according to his words, compliance with the law with the fact of "postponing" the provincial congress, which has not taken place on time due to "exceptional events" due to the pandemic, a delay For this reason, he added, he is "absolutely justified and protected".

For his part, the lawyer for the plaintiff members has pointed out that the PP could "have appealed for reinstatement" to the summons of the national president of the popular, Alberto Núñez Feijóo, but that he did not.

In his words, by not presenting the appeal, the PP "knew" that Feijóo would have to go to Salamanca, who "clearly" has "knowledge of these facts, of course", in reference to the postponement of Congress, for being a member of the Committee since 2005 and for being president of the PP in recent times, he has apostilled.

Regarding the appreciation from the PP that the delay has been "a consequence of the Covid", the lawyer of the plaintiff affiliates has indicated that "Salamanca is not the central nucleus of the covid in the world" and that from March 2021 to September of the same year those of Ávila, Valladolid, Palencia have been held.

Zamora, Burgos, León, Segovia and Soria, in addition to the regional one on January 15, 2022.

For this reason, he has criticized the lack of the one in Salamanca because Genoa "is not interested in having it held in Salamanca", and has alluded to "public and notorious reasons". So that two years of delay are not met in May, the plaintiffs have asked the Justice for precautionary measures that urge that it be convened within a period of 45 days.

For its part, the Public Prosecutor's Office has advocated "dismissing the precautionary measure", since it calls for the congress to be held in 45 days and that, with it, "the same thing is requested" as with the "substantive case", within a process of precautionary measures that the judge has left "seen for judicial resolution".
