The forum where an ex-soldier acknowledged having published photos and data of the victim of "La Manada", in addition to images of the sexual assault, must respond as subsidiary civil liability in the event that the man -- who accepted a sentence of two years in prison--do not pay the 20,000 euros in compensation that the judge has set.

In a sentence consulted by Europa Press this Thursday, the Criminal Court 1 of Barcelona includes the sentence for the ex-soldier already agreed in the trial, in November, for a crime against moral integrity and a crime of revealing secrets.

In addition to the two-year prison sentence -which he will not serve for not having a criminal record-, the man must pay a fine of 1,320 euros and compensate the victim with these 20,000 euros which, if he does not pay, will be claimed from 'foroparalelo' .com'.

To justify the subsidiary civil liability of the forum, the judge recalls that the Court of Navarra, which judged the case of 'La Manada', had prohibited the dissemination of data or images of the victim, which implied for the forum "a special diligence of its holders in the control of the messages or images" that will be published on their platform.

In addition, the judge points out "the defendant's passivity in the face of these comments posted on her website, her lack of diligence in removing them or making them inaccessible" despite the fact that other forum users warned of the ex-military's publications.

It adds that, when the National Police sent him a request as a result of the victim's complaint to delete the comments "he did not proceed to withdraw them, but rather they continued to be hosted on that website and accessible to the public" until more than a year later.

Regarding the ex-soldier, who had more than 100,000 followers in the forum, the sentence recalls that he published a thread of comments entitled 'faggot balls are missing', "with the intention of mocking and causing moral concern to the victim of 'La Manada', and with desire to publicly humiliate and mock her for being a woman", published personal information such as her ID, address, the university where she studied, photos of her and a video capture of the sexual assault she suffered.

The publication "caused third parties and people close to the victim to discover that she was the victim of that highly publicized judicial process," and the fear of being recognized led her to change her address.
