The dean judge of Bilbao says that Irene Montero accuses the judicial right for the reduction of sentences to cover up her mistake

BILBAO, 30 Ene. (EUROPA PRESS) -

The dean judge of Bilbao, Aner Uriarte, has shown himself in favor of reforming the new Law of 'Only yes is yes' and has rejected that there is a "conservative bias" in the reduction of sentences for sexual offenders that is taking place due to the application of this norm.

In an interview with Radio Euskadi, collected by Europa Press, Uriarte considered that the new Law should be modified because he understands that "it was not intended" that the result of the application of the norm would be a "such high number of reductions in sentences and releases".

"If there is an error, the normal thing would be to fix it. The issue is that it is not easy because you can try to limit this problem since some sentences have had to be reduced because the criminal forks are lower or wider below than the ones it had the previous Law, but that will not solve the problem for all criminals convicted up to now and for those who may be convicted in the future, except for those acts that are committed after the entry into force of this reform", he stressed.

Regarding the willingness of the Minister of Equality, Irene Montero, to address a reform of the new rule, but "protecting that consent remains at the heart of the Penal Code", the magistrate believes that "consent has always been" there . "The Penal Code, for a long time, revolves around the consent of the victim," he added.

After emphasizing that with the reform crimes against sexual freedom have been reorganized and those of sexual abuse have been integrated, less serious since there is no violence or intimidation, the minimum limit of sentences has been lowered, which "leads reductions in sorrows".

For this reason, it has insisted that, if this Law is modified, "the problem would be solved" for the crimes that are committed after the entry into force of the eventual reform, but not for those perpetrated previously.

The senior judge in Bilbao has insisted that the accusation by the Minister for Equality, Irene Montero, of "machismo" of the "judicial right" is "really reprehensible", and believes that it is "an excuse to try to cover up this error". that his Ministry has committed with the new Law of only yes is yes.

"Politicians cannot sell that so many sentences are reduced. It is very unfair because all judges have an ideology, but they teach us from the outset to resolve regardless of our ideology," he stated.

For this reason, he has invited all those who claim that "all this is the product of the judicial right or of heteropatrial justice" to tell him what is the "conservative bias" of the courts in reducing sentences and what would be "a non-conservative bias".

"Here a constitutional norm is being applied, which is the reverse of the retroactivity of the new Law," he said, to point out that its application "is not more conservative or progressive or a middle point." "It is the application of the Law", she has reiterated.

Aner Uriarte, who has been re-elected as head of the Dean's Office for the next four years, has considered that there are two challenges, one of which is the implementation of the digital file in all jurisdictions. Specifically, today it is implemented in the Civil courts.

"One more challenge in the medium term is to inaugurate the new Palace of Justice in 2025, which will correct the endemic problem that we have had in Bilbao for a long time, which is the lack of judicial spaces. In this process, the challenge is to substantially improve the configuration of the courts of the criminal jurisdiction that are in a judicial building that is not excessively suitable for it, in Buenos Aires, and as a consequence of this rearrangement, we will try to occupy the upper floors of that Palace and improve what today can be improved ", he indicated.

When a week-long strike by the Justice lawyers is going to take place this Tuesday, Aner Uriarte explained that the judges are "eyewitnesses" of this strike, although he has admitted that "many trials are being paralyzed", more in the jurisdiction Civil than in other orders.

After pointing out that they respect the right to strike of the lawyers of the Administration of Justice, he recalled that, without them, they cannot "close the trials". "We are looking forward to settling the differences they have with the Ministry of Justice and returning to normality," she stated.
