The fourth section of the Provincial Court of Pontevedra has reduced from 12 to seven years, in application of the so-called "only yes is yes" law, the prison sentence imposed on a man for sexually assaulting a woman with an intellectual disability .

The court explains that the range provided when the sentence was handed down for the crime committed was 12 to 15 years in prison, for which reason it was imposed in its minimum degree.

The application of the new law, according to the order, entails a penological fork of seven to 15 years, which is why it underlines that, when the sentence was applied to its minimum degree, as it was in the individualization of the sentence in the sentence handed down that became firm, the penalty to be imposed must be seven years in prison.

In the proven facts of the sentence, it is confirmed that the man, a Ghanaian national and with legal residence in Spain, met the woman at the door of a shop in Pontevedra, invited her to have a drink and, later, to go up to her home, where he sexually assaulted her.

Since the entry into force of Organic Law 10/2022, of September 6, on the comprehensive guarantee of sexual freedom, the Galician provincial courts and the Superior Court of Xustiza de Galicia have reviewed and issued at least 105 decisions --both reviews of penalties already imposed as resources--referred to convictions.

Of these, at least 51 have resulted in a reduction in the sentence of the criminals, while in the rest of the cases, the sentence has been maintained because the Law of 'only yes is yes' would mean that the trial would end with an equal sentence. or greater than the one that was set at the time, all according to data from the General Council of the Judiciary (CGPJ).
