The Court of Malaga will analyze sentences of those convicted of sexual assault in case the sentences should be reviewed

The five criminal sections of the Malaga Court have begun to analyze sentences ex officio to see if it is appropriate or not to carry out a review of the sentences as a result of the application of the 'only yes is yes' law. And it will be done studying "case by case".

This was reported this Friday by the president of the Court, Lourdes García Ortiz, after holding a meeting of criminal magistrates last Thursday to address the application of the reform of Organic Law 10/2022 and the review of sentences imposed.

García Ortiz explained to journalists that the first thing that will be done is "analyze the cases that we have in execution of prisoners who are serving their sentence to see if it is susceptible to being reviewed or not with respect to this law that in some aspects has decreased the sorrow".

"It is not that they are reviewed yes or yes, but rather that a process is initiated to determine whether they have to be reviewed or not," pointed out the president of the Court, who has calculated that there will be a hundred enforceable sentences that will be analyzed, pointing out that the requests by the defenses for now are "few".

He explained that in the cases that it is seen that this review is necessary, the process will begin and the prosecutor and all the parties will be notified to report on it; and he has specified that sentences that are suspended or cases in which the penalty is equal to the new law will not be reviewed.

García Ortiz has insisted that it will be analyzed "case by case, individually; this is not a general rule that I apply on a roller, we are talking about very serious causes and we must hit the mark", pointing out that they will also be attentive to the criteria of the Supreme Court .

He has defended the training of judges; "we are jurists, courts that we have to apply the law". Questioned about the accusations that have been made against judges for applying the "only yes is yes" law, she has said that she adds to the statements that have been made on this subject. "I reject what was said against our profession", she has pointed out.
