SEVILLA, 6 Mar. (EUROPA PRESS) -

The Investigating Court number ten of Seville, which is investigating the listeriosis outbreak that arose in 2019 due to the shredded meat distributed by the Magrudis company despite being contaminated with said bacteria; has declared said company and four of the defendants insolvent, in relation to the bonds that were claimed from them, according to a series of new decrees collected by Europa Press.

Specifically, the defendants in this case are José Antonio Marín Ponce, de facto administrator of Magrudis; his wife, Encarnación Rodríguez Jiménez, responsible for production and start-up of the company's self-control system; his sons Sandro José Marín Rodríguez, sole administrator of the aforementioned company, and Mario Marín Rodríguez, sole administrator of Elaborados Cárnicos Mario; Sergio L.G., technical architect, and María José Ojeda, municipal veterinary inspector.

Last November, the court opened an oral trial against five of those investigated -Sandro José M.R., José Antonio M.P., Mario M.R., Encarnación R.J. and María José O.B.-, Magrudis S.L. and Processed Meat Mario S.L. for a crime against public health in an ideal contest with four crimes of reckless homicide, seven crimes of injury to the fetus due to serious negligence resulting in abortion and 245 crimes of injuries due to serious negligence, declaring civil liability to the insurance companies Axa S.A., Aig Europe S.A. (Spain branch) and Zurich Spain Insurance and Reinsurance Company.

Likewise, I would open oral trial against Sandro Jose M.R., Jose Antonio M.P. and Sergio L.G. for an alleged felony of forgery in official document, as well as against Jose Antonio M.P., Sandro Jose M.R., Encarnación R.J and Mario M.R. for a misdemeanor of electric fluid fraud.

In her order to open the oral trial, the magistrate required Magrudis S.L. and Processed Meat Mario S.L. so that, within one day, "they provide a joint and several bond in the amount of 5,166,688.50 euros (homicides, abortions, injuries, compensation to the Junta de Andalucía and the Seville City Council)", and 36,000 euros "as liability pecuniary that could be imposed on them".

In addition, it required the investigated Sandro José M.R. and José Antonio M.P. so that, within the same period of one day, "they provide a joint and several bond in the amount of 5,166,688.50 euros (homicides, abortions, injuries, compensation to the Board and the City Council)" and 3,060 euros "as pecuniary liability that could be imposed on them ".

The judge also required the investigated Mario M.R. and his mother Encarnación R.J. so that in the same period "they provide a joint and several bond in the amount of 5,166,688.50 euros (homicides, abortions, injuries, compensation to the Board and the City Council)" and 1,440 euros "as pecuniary liability that could be imposed on them."

Lastly, it required the defendant María José O.B. so that within one day "provide solidarity bail in the amount of 5,025,648.40 euros (homicides, abortions, injured, compensation to the Andalusian Government)", and to the accused Sergio L.G. so that "he provides a joint and several bond in the amount of 1,440 euros as pecuniary responsibility that could be imposed on him."

All this, according to the investigating judge, "to ensure the pecuniary responsibilities that, ultimately, could be imposed on him", with the warning that, if he does not provide the different guarantees established in the order, "sufficient assets will be seized to ensure the amount indicated.

Now, through different decrees collected by Europa Press, the court has declared Magrudis, Elaborados Cárnicos Mario, José Antonio Marín Ponce, de facto administrator of Magrudis, insolvent against such bonds; his wife, Encarnación Rodríguez Jiménez, responsible for production and start-up of the company's self-control system; and his sons Sandro José Marín Rodríguez, sole administrator of the aforementioned business, and Mario Marín Rodríguez, sole administrator of Elaborados Cárnicos Mario.

After these defendants did not deposit the bonds claimed within the period authorized for it, the court indicates that "since there is no record" that they have "assets subject to seizure to ensure the liabilities that may be imposed, it is appropriate to declare" their insolvency, "without prejudice to what proceed in the event that in the future his fortune improves".
