The Constitutional Court will study next week if it admits Vox's appeal against the 'law of only yes is yes'

The new Constitutional Court (TC) will hold its first jurisdictional plenary session next week to study whether it admits Vox's appeal against what is known as the 'law of only yes is yes' and that of the Government against the Catalan housing law, among others. matters, as reported by the guarantee court on Wednesday.

Vox's appeal, whose presentation has fallen to magistrate Ramón Sáez, is directed against the fourth, seventh and seventeenth final provisions of Organic Law 10/2022, of September 6, on the comprehensive guarantee of sexual freedom.

The legal vice president of Vox, Marta Castro, explained when presenting the challenge that they were appealing because they believe that the new law is a "legal aberration" for "violating all the basic principles of the legal system and the Constitution."

Castro indicated that it violates the principles of legality, legal certainty and presumption of innocence, since, in his opinion, the new regulation of consent "inverts the burden of proof."

For those of Santiago Abascal, the law leaves "victims unprotected" and allows a "very broad framework of discretion for analysis by the judge, in each of the cases."

The Constitutional, based on a presentation by María Luisa Balaguer, will also study the admission of the appeal of the President of the Government against article 12 of the Law of the Generalitat of Catalonia 1/2022, of March 3, which modifies the one destined to " deal with the emergency in the area of ​​housing".

Already in the first deliberation, the court of guarantees will analyze another appeal by Vox against article 2 of Decree-law of the Generalitat of Catalonia 4/2022 on urgent measures in the tax and financial field, whose presentation is also dealt with by Sáez.

It will also review in first deliberation the question raised by the Superior Court of Justice of Catalonia (TSJC), in a presentation by Enrique Arnaldo, on the Decree-law of the Generalitat of Catalonia 6/2022, which establishes the criteria applicable to the elaboration , the approval, validation and revision of the linguistic projects of the educational centers; and Law 8/2022 on the use and learning of official languages ​​in non-university education.
